Always Look At Manufacturer Liability In A Florida SUV Rollover Car Accident
The St. Augustine Record reported today a Fort Lauderdale woman and her two kids were transported to the emergency room with injuries. The accident apparently occurred after one of the tires of the SUV they were traveling in separated, causing the SUV to flip several times.
The 33 year old driver was proceeding north on Interstate 95 and was less than a mile from State Road 206 when the accident happened.When the tire separated the driver lost control of her 1997 Ford Explorer, which then overturned.
The driver and her daughter inexplicably were not wearing seat belts at the time of the accident, a Florida Highway Patrol report indicated.The driver's child, who was seriously injured was airlifted to the hospital after she was ejected from the SUV. FHP reported that the driver's 8 month old baby was properly and thankfully restrained by a child seat in the rear passenger seat.
When involved in a SUV rollover accident, where no third party vehicle is involved, the injured parties and their attorneys should investigate the possibility of a cause of action for negligence on behalf of the manufacturer of the SUV.
The Insurance Institute for Highway Safety (IIHS) released a report in 2005, which found finding that Ford Explorers made between 1999-2002 had the fourth highest rate of driver fatalities of the 47 SUVs that were part of the study.
