Details Emerge In South Florida Accident Where Man Jumped Out Of Taxi And Was Killed On Miami Expressway

A medical examiner's report says a man who was fatally struck by a car on an expressway after jumping out of a taxi was a 24-year-old from Cuba.

Lizandro Marino-Morales went to
Mexico after leaving Cuba about a week ago. He then went to Dallas
and boarded a flight to Miami where he planned to stay with a
cousin.

While in a taxi early Tuesday morning (9-28), authorities say he
started muttering to himself and jumped out of the car. The Florida
Highway Patrol says Marino-Morales laid down in the middle of the
Palmetto Expressway and was killed by an oncoming car.

Marino-Morales was married and studying to be an engineer.
Relatives told the medical examiner's office Wednesday, September 29 that he had no known medical issues.

No charges have been filed.

Florida School Bus Accident Sends Four Injured Children To Hospital

A minor school bus crash in Davie resulted in four children being taken to a hospital.

The crash was reported just outside of the Holy Sacrament Episcopal Church and Academy on the 2800 block of University Drive about 9:30 a.m. It was a minor incident involving a car and the bus, said Braulio Rosa, of the Davie Fire Department.

After the crash, the driver of the bus continued to the front of the school and dropped off the kids. Police and firefighters were called to the scene, and 13 of the 36 children on the bus were evaluated for possible injuries.

Four of those children were taken to Memorial Hospital Pembroke to be evaluated for minor injuries. Police are investigating the cause of the crash.

Driver Arrested After South Florida Accident That Killed Inline Skater

Miami-Dade police have arrested the woman they said crashed into a man who was rollerblading and then left him to die in the middle of the road.

Nicole Mitseas, 23, was charged with leaving the scene of a fatal accident, a felony punishable by time served in prison.

According to the arrest form, Mitseas struck 39-year-old Karl Arvidsson with her Honda sedan and then fled the scene.

"She should have stayed. She could have save his life," said Arvidsson's wife, Holly.

She said she was relieved to hear someone had been arrested, but she questioned why it took nearly a month to hold Mitseas accountable. She also wondered why Mitseas was never given breathalyzer test.

"Considering where she was coming from, I'm sure she was drinking,"said Arvidsson.

The incident happened at about 3 a.m. Monday on Old Cutler Road near 169th Street.

Arvidsson was rollerblading to the bus stop to head to his early-morning shift as a maintenance manager.

Mitseas was reportedly driving home from a dinner party.

Both were heading northbound when Mitseas struck Arvidsson from behind, police said.

Police would not speak on camera but said driving home at 3 a.m. and fleeing the scene did not warrant a breathalyzer.

Mitseas turned down requests for comment. Immediately following the accident, however, her father said she had not been drinking.

"She wasn't DUI or nothing. She just panicked and left," said Tom Mitseas.

According to the arrest form, Mitseas eventually returned to the scene of the crash with her mother in a different car.

Arvidsson had already been airlifted to Jackson memorial where he died.

Records show that Mitseas has been pulled over in the past for driving the wrong way down the highway and reckless driving.

Arvidsson hopes she will finally be taken off the road.

Meanwhile, Mitseas is out on bail and free to drive. An arraignment date will be set in the coming days.

Driver Involved In South Florida Car Accident That Killed Miami Heat Dancer Admits To Have Been Drinking

The driver involved in a crash that claimed the life of a new Miami Heat dancer admitted to police at the crash scene that he had consumed two alcoholic beverages prior to the collision, WFOR-Ch.4 reported late Wednesday.

The station obtained a copy of a search warrant filed in Broward County court that stated Mario Careaga, of Fort Lauderdale, told officers he had the drinks at the Galleria Mall.

Careaga has not been charged in the Sept. 10 crash.

Police said Careaga was driving his 2009 Mercedes when he struck Nancy Lopez-Ruiz, 22, of Plantation, who was riding a 2003 Suzuki motorcycle near downtown Fort Lauderdale.

Lopez-Ruiz had been heading west in the right lane on East Sunrise Boulevard, near North Federal Highway, when Careaga crashed into the back of the bike, throwing Lopez-Ruiz off of it, police said.

Weston Man Dies Instantly In South Florida Car Accident On I-595 Ramp

A 37-year-old man died early this morning after he lost control of his car and hit a concrete bridge support on a ramp to Interstate 595, the Florida Highway Patrol reports.

The single-car crash was reported just before 4:30 a.m. on an eastbound ramp on State Road 84 that connects to I-595. James Vincent Zumma, of Weston, instantly, said FHP spokesman Sgt. Mark Wysocky.

The ramp was closed until just after 8 a.m. as troopers investigated the scene.

Jury Finds Crane Operater Was At Fault For Accident

On Nov. 6, 2002, plaintiff Larry Tidwell, 62, a crane operator, was operating a Terex RT 230 "Rough Terrain" crane at the Equistar facility at Chocolate Bayou in Brazoria County. According to Tidwell, the accelerator became sticky with mud. He raised the outriggers and swung the cab and boom to the right, which he said the crane was designed to handle without outriggers. He claimed that he locked the "swing brake," which keeps the boom from swinging. After he climbed out to clean the mud off the floorboard, the crane tipped over backward and injured him.

The manufacturer was Koehring Cranes Inc. Koehring's parent was Terex Cranes Inc., whose parent, in turn, was Terex Corp.

Tidwell sued the Terex entities and Koehring for products liability, alleging design defect and marketing defect.

The design claim was based in part on the lack of a warning light to indicate that the axle lockout system (which locks the rear axle in place) was not operational. Tidwell's counsel said some cranes have a warning light. Also, Tidwell alleged that the lockout was designed to "fail dangerous," rather than "fail safe" in a locked configuration. He also said the swing brake failed.

As to marketing, Tidwell alleged that the operator manual and checklist did not state or did not state clearly that the operator should check the lockout to make sure it was functioning.

The defense argued that someone had intentionally disconnected the lockout, perhaps for a smoother ride. The defense also argued that lockouts had been around for 40 years; were very safe designs; that a warning light was not only not feasible, but not necessary, and would not have made any difference in this accident.

According to the defense, after Tidwell exited the cab, the boom swung further right, positioning the counterweight over the left rear tire and redistributing the center of gravity, which in turn caused the crane to tip over.

Also, according to the defense, the plaintiffs' alternate lockout design, which would lock the axle when disconnected, would have been more dangerous than the existing design.

The defense argued that the manual was adequate and that the plaintiff had not read it anyway. Tidwell's attorney said his client had it before, just not on the day of the incident.

The defense argued that Tidwell failed to know the machine thoroughly; should not have swung the boom to the side without outriggers and without first checking the lockout; and failed to lock the swing brake.

Tidwell had been hired out of the crane operators' union by a crane contractor. At the time of the incident, he had been operating cranes on the Equistar turnaround for about four weeks. The date of this incident was the first time he had operated this particular model. His attorney said that previously he had been operating an RT 550 and that it is a similar model.

Tidwell fractured his left tibia and fibula. He also claimed a neck injury, a traumatic brain injury and cognitive and psychological problems.

He underwent repeat intramedullary nailing and removal of hardware for his leg, plus a cervical fusion. He claimed past medical expenses of $316,000. His attorneys said that the workers' compensation carrier did not timely provide medical documentation for another $410,000 in medical expenses. Tidwell claimed a life care plan of about $4 million. He had not worked since the accident.

His wife claimed loss of consortium.

The defense argued that the Tidwell's neck surgery and cognitive and psychological problems were unrelated to the accident.

Jury found no design defect and no marketing defect and found that the Tidwell was negligent.

The plaintiffs plan to file a motion for new trial.

NTSB Cites Fatigue In Car Accident That Killed Ten

Federal safety investigators say a tractor-trailer truck driver who slammed his rig into a line of cars stopped on a stretch of Oklahoma highway last year, killing 10 people, was likely suffering from fatigue.

Investigators told the National Transportation Safety Board the 76-year-old driver most likely had five hours of sleep before beginning his workday on June 26, 2009. He left Springfield, Mo., just after 3 a.m. By the time he was 90 miles northeast of Tulsa, the accident site, he had been on the road for more than 10 hours.

Creed also suffered from sleep apnea, which causes abnormal pauses in breathing and can prevent restful sleep.

The board is meeting to determine the cause of the accident and make safety recommendations.

Pedestrian Struck And Killed By Train In Florida Accident

The Walton County Sheriff's Office is investigating the death of a pedestrian who was hit by a train Tuesday evening.

The Sheriff's Office was called around 7:20 p.m. when the train's chief engineer told dispatch he believed the train struck a person standing on the tracks, according to a Walton County Sheriff's press release.

The white man, whose identity is being held pending notification of the next of kin, was located adjacent to the tracks on the south side at the intersection of U.S. Highway 90 and Second Street.

The Sheriff's Office, along with CSX Railway Police and the Medical Examiners Office, isn investigating the death.

South Florida Car Accidents From Tropical Storm Nicole Rains Slow Traffic In Palm Beach County

The roads are slick and a handful of crashes are already putting a crimp in the morning commute.

The Florida Highway Patrol has reported a steady stream of incidents on Interstate 95, despite traffic being at a crawl in some spots. Still, none of the crashes are currently blocking the roads.

Palm Beach County's side roads are also experiencing their share of fender benders and slowdowns.

Florida Highway Patrol has this advice for those driving in the rain:

* Turn on headlights - but not the high beams or flashers.

* Take those turns and curves slower than you normally would.

* Increase your following distance and brake earlier than you otherwise do.

* Most roads are "crowned" in the middle so that water runs to the side, so stay in that middle area when you can.

* Don't use cruise control. If you hydroplane your car could speed up.

* Don't cross running water.

* Be vigilant about signaling turns.

* Give buses and trucks extra distance to avoid blinding splash back.

So far, Palm Beach County Schools buses appear to be running on time and there have been no major problems with kids getting to school.

Series Of Florida Car Accidents Temporarily Shut Down I-75

A series of crashes closed the northbound lanes of Interstate 75 near the Newberry Road interchange during rush hour Wednesday morning.

At about 8:38 a.m., a car blew a tire, according to Alachua County sheriff's officials. As the driver struggled to control that car, it set off a series of collisions.

Florida Highway Patrol was dispatched at 8:40 and was on scene at 8:50 a.m., according to the agency's website. It indicates the crash was on the overpass.

All three lanes of I-75 northbound were temporarily closed, but deputies had one lane re-opened within 30 minutes and all lanes re-opened within an hour.

Florida School Bus Accident In Mandarin Results In Injuries

One person was hospitalized in critical condition after being be cut from a vehicle in an accident this morning with a school bus that closed a main road in Mandarin.

Two students were taken to a nearby hospital as a precaution but there were no reports of serious injuries on the bus in the 6:40 a.m. accidentat Old St. Augustine Road and Deeder Lane, police said.

The driver of the car, whose name and age were not immediately available, was taken to Shands Jacksonville in critical condition after he was extricated from the vehicle, said Jacksonville Fire and Rescue Department spokesman Tom Francis.

Police said the man driving a Toyota Matrix rammed the back of a Mandarin High School bus that was stopped to pick up students at Deeder. A 10th grader who was getting onboard said the impact knocked her backward and that she was hit in the face by the door.

The bus was displaying stop flags and was flashing lights when the accident happened, said Assistant Chief Annie Smith of the Jacksonville Sheriff's Office.

School spokeswoman Jill Johnson said a backup bus was sent to the scene to take students on to the school.

Florida Car Accident After Escorts Rob Man

Authorities said two female escorts robbed a Maitland man overnight and then led police on chase that ended in Orange County's Parramore neighborhood.

A Maitland Police Department officer also lost control of his patrol car while chasing the women's vehicle.

Officials said the Maitland man had invited the women to his home on The Oaks Drive sometime around 2:30 a.m.

The victim told police the women robbed him and fled his home.

At some point, the Maitland officer spotted the women's Ford Explorer and chased them; however, the officer crashed his patrol car into a light pole at the Lee Road on-ramp to Interstate 4.

Orlando andWinter Park police took over the incident and located the women's abandoned SUV on Westmoreland Drive and 25th Street in Orlando.

Officers said the suspects have not been located. Investigators did not release descriptions of the women.

Taxicab Passenger Dies In South Florida Car Accident After Running Into Traffic On Palmetto Expressway

A man flew to Miami, hailed a taxi and muttered wildly in Spanish before running into traffic on the Palmetto Expressway early Tuesday.

"What are you doing?" the incredulous taxi driver had shouted a second earlier, seeing the man unbuckling his seat belt and reaching for the door.

Moments later, the man was dead.

The passenger, whose identity was not known, lay facedown in the center lane at around 3:30 a.m. as the driver yelled at traffic to veer away. However, the man was struck and killed by a pickup truck.

Investigators on Tuesday were still unraveling what appears to be a mysterious suicide on the busy highway.

"We're trying to figure out who this gentleman was and tell the story of why all of this took place," said Lt. Alex Annunziato of the Florida Highway Patrol, which is investigating the death just north of Northwest 25th Street.

This much is known about the man and his travels:

He arrived Monday night at Miami International Airport on an American Airlines flight that originated in Laredo, Texas. He changed planes in Dallas. The man carried foreign identification that was difficult to read. Authorities have been in contact with police in Texas, but have not been able to determine his identity.

The last flight from Dallas arrived at MIA at 10:36 p.m., airport officials said. FHP would not say if the man had been on that flight.

Around 3 a.m., the man hailed a Yellow Cab waiting at the airport.

The man asked the driver if he could sit in the front seat, a slightly unusual request, but one the driver honored. The man asked to be dropped at a Hialeah Gardens address. Authorities say the address doesn't exist.

Minutes into the ride, the man became agitated, said Michael S. Kaufman, an attorney representing Yellow Cab. He spoke wildly to himself in Spanish and waved his arms, Kaufman said.

The FHP had a slightly different version of events, saying that the man was talking on the phone and became irate, screaming and wildly waving his hands.

On the Palmetto near Northwest 25th Street, the passenger took off his seat belt and reached for the door, Kaufman said. The driver yelled and pulled onto the emergency shoulder of the road, Kaufman said.

The startled driver started to call 911 as the man bounded into traffic and hit the ground. The driver "walks into traffic because traffic is zooming by and starts waving other vehicles around him," Kaufman said.

At least two other good Samaritans stopped and tried to wave the traffic away, Kaufman said. At least two cars avoided the man.

But the driver of a 2008 Nissan pickup truck did not stop, hitting the man and continuing on. The driver then flagged down a trooper, saying he had just hit a man and was returning to the scene, Annunziato said.

That driver's name was not released. He has not been charged.

Kaufman would not identify the cab driver until FHP releases his name, but said he has been with the company for more than 10 years.

"It's a tragedy and bizarre as well," Kaufman said. "But when you're a taxi driver, it's one of those risks you run picking up strangers."

Fatal Florida Car Accident In Mulberry

One person was killed and five injured in a Mulberry crash this morning, according to the Polk County Sheriff's Office. Two vehicles crashed near Anderson Road and County Road 640 about 8:30 a.m., and both roads are closed. One person died at the scene. Two are in critical condition at Tampa General Hospital, and three are in serious condition at Lakeland Regional Medical Center, according to the Sheriff's office. More information is unavailable but will be posted as it's received.

FHP Says Hydroplaning Teen Caused Chain Reaction Florida Accident

The Florida Highway Patrol has determined that a teen driver whose car began to hydroplane during Monday's torrential rainstorm was what set off a chain reaction of accidents on Interstate 75. When the crash ended, troopers said 15 vehicles and 26 people were involved.

While no one received any life-threatening injuries, three victims were seriously injured, 13 people received minor injuries and 10 people were not injured. The crashes happened in the northbound lanes of I-75 about a half mile north of Northwest 39th Avenue and began at 1:13 p.m. during the height of a storm that dumped up to an inch of rain on the freeway, according to the National Weather Service.

Officials said it took more than six hours for the damaged vehicles to be removed and traffic to return to normal.

According to a preliminary crash report by Trooper Saundra Batie, the event began when Leonard T. Myers, 16, of Alachua, lost control of the 2008 Nissan four-door that he was driving because it was hydroplaning. The Nissan spun off the roadway before coming to a stop facing west across the west side emergency lane and one traffic lane, Batie wrote in her report.

Batie noted that while charges are pending, Myers "Failed to use due care when special hazards existed."

A Lake City woman who stopped to help Myers, Kristin Lange, 23, was out of her 2004 Toyota truck when it was hit by other vehicles trying to stop. Myers was taken to Shands at the University of Florida in serious condition.

Batie said that drivers of another 13 vehicles attempted to take evasive actions by braking or steering away from other vehicles that had slowed or stopped because vehicles ahead of them had slowed or stopped.

"Due to the wet, slippery roadway they were unable to avoid the collision," Batie said.

The other people who were seriously injured and taken to Shands were identified as Gwendolyn M. Marshall, 34, of Tallahassee who was driving a 2010 Hyundai four door, and Debra N. Orden, 50, of Clemmons, N.C. who had been driving a 2007 Dodge van.

An investigation into the crash was continuing on Tuesday morning.

Five Injured In South Florida Car Accident

Five people were transported to hospitals after a serious crash on Orange Blossom Trail in Orlando this morning, according to Orange County Fire Rescue.

The Florida Highway Patrol reports that the crash happened about 7:15 a.m. near Rosamond Drive.

A rescue crew had to use the "jaws of life" at the scene of the two-vehicle crash to remove four of the people, who were trapped in their vehicle.

Two children were among the injured patients, according to the fire-rescue department.

Troopers are investigating the incident.

Several northbound lanes on the Palmetto Expressway were shut down early Tuesday morning after a man was struck and killed on the highway.

According to Florida Highway Patrol officers, a passenger in a taxi cab was involved in an argument with the cab's driver while traveling northbound on the expressway at Northwest 25th Street.

The man then got out of the car and lay down in the middle of the road. Another vehicle came and hit him, according to police. The man died.

The driver of the taxi cab is cooperating with officers.

The incident is under investigation.

A freshman at Florida Gulf Coast University died in a car accident in Orlando on Thursday, according to an e-mail sent to students and faculty by President Wilson Bradshaw.

Morgan Crofton was a criminal forensic studies major in the College of Professional studies and was a graduate of Winter Park High School.

Fatal Florida Car Accident Near Tampa's NFL Football Stadium

A 76-year-old woman died Sunday in a five-car crash near Raymond James Stadium hours before kick-off of the Tampa Bay Buccaneers game, the St. Petersburg Times reported.

Teresa Gonzalez Cruz was pronounced dead at about 1 p.m. at St. Joseph's Hospital.

The crash occurred after a driver ran a red light at North Himes Avenue and Spruce Street, according to the Tampa Police Department.

Detectives are investigating the cause of the crash.

The late-morning accident closed the intersection for several hours, causing traffic back-ups as football fans headed to see the Bucs.

Man In Florida Accident With Scooter Sues Bar That Served Him Drinks

A 73 year old Bradenton area man who crashed his motorized scooter after too many drinks is suing the bar that served him.

The Bradenton Herald reports John Wasko of Manatee filed a lawsuit last week against The Oasis, saying the bar should have stopped giving him drinks.

He's seeking more than $15,000 in compensation.

Bar owner Brenda Cays said she's unaware of the lawsuit but that her staff stops serving when necessary.

She saids she's driven patrons home and paid for taxis for drunk customers.

The suit stems from a Jan. 18 incident. Wasko was riding home on his scooter when he was struck by a vehicle. He blames injuries from the accident on the bar. Bradenton police cited him for walking in the path of a vehicle.

Man Killed In Florida Accident In Jacksonville After Losing Control Of Motorcycle

A man died early Monday morning after he lost control of his motorcycle and struck a pole, the Jacksonville Sheriff's Office said.

Detective Robert Peck said Kayland Byirt, who was identified by detective Darrell Edmonds, was southbound on Moncrief Road when he lost control of the motorcycle about 3 a.m. near West 27th Street. Byirt was thrown off after his motorcycle struck a pole and came to rest at Moncrief Road and Myrtle Avenue.

The 28-year-old died at the scene.

Peck said speed and wet roads were factors and added that Byirt was not wearing a helmet.

Fatal South Florida Accident Friday When Mazda Carrying Four Jehovah's Witnesses Is Crushed By Truck

Mary Niemoeller was headed out to spread the word as a Jehovah's Witness Friday morning, when a truck crushed the car she was in from behind, killing her and injuring three other women in the car.

The wreck put an end to decades of witnessing when it killed the 61-year-old Greenacres mother of five, grandmother of two, reckoned Lenore "Lynn" Ayliffe, Niemoeller's older sister.

"It's sad that's she's gone so soon. She loved animals, she loved to cook and loved to garden. She just loved life," said Ayliffe, who said their family grew up in the area and that Niemoeller attended Lake Worth High School before starting a family.

Niemoeller was in the backseat of a Mazda driven by Ranysha Lenaye Turner, 19. Also in the car: Regine Turner, 16, and Alicia Nell Tucker, 36. All three lived in West Palm Beach, according to Palm Beach County Sheriff's deputies investigating the crash.

The crash happened shortly before 6 a.m. on Southern Boulevard just east of Sunshine Road.

According to reports, Ranysha Turner had just completed a right turn off Sunshine onto westbound Southern and was accelerating in the outside lane.

Wilson Phillippe, 33, of Port St. Lucie, was westbound on Southern in the outside lane. A uninvolved vehicle in front of Phillippe slowed to make a right at Sunshine, so Phillippe partially changed lanes to go around.

While merging back over, the front of his truck struck and mounted the rear of the Mazda, the report said.

Both vehicles left the roadway, crossed over the sidewalk, struck a street light pole and came to rest in the grass near a canal, the report stated.

Niemoeller is survived by five children, three grandchildren and three sisters, Ayliffe said. Details regarding a memorial service for Niemoeller are expected to be announced this week.

FHP Says Fatal Florida Car Accident Caused By SUV Traveling On Wrong Side Of Road

A fatal crash Friday night was caused by a driver who was going the wrong way on East State Road 50 into oncoming traffic, the Florida Highway Patrol said Saturday.

Troopers said they're still not sure why Catherine Petersen, 50, of Winter Springs, was driving west in the eastbound inside lane on S.R. 50 near Ponchos Lane in Christmas about 8 p.m. Friday.

Investigators said Petersen's Hyundai sport utility vehicle crashed head-on into a Honda Prelude driven by Calvin Williams, 33, of Christmas.

Williams was taken to Florida Hospital East and later died, troopers said. Investigators said Williams was not wearing a seatbelt.

Troopers said the collision spun the Prelude and lifted its rear into the air. It came down on the front end of a Ford Escort that was passing the initial crash.

Troopers said the Escort came to rest with the Prelude resting partially on its hood. Orange County Fire Rescue officials said late Friday that firefighters had to use special equipment to remove all three drivers from the wreckage.

The driver of the Escort, Jeffrey Rory Eller, 42, was taken to Parrish Medical Center in serious condition. Petersen was taken to Orlando Regional Medical Center, also in serious condition.

Troopers on Saturday said the crash is still being investigated and charges are pending. Tests to determine whether Petersen or Williams were under the influence of alcohol at the time of the crash also are pending.

South Florida Bike Accident Victim Advocates Helmets

When Brenda Bartlett was 14 years old, she was riding her bicycle in her neighborhood and a car hit her.

"I was always told I was knocked out completely -- I mean, knocked out right away," Bartlett said.

Batlett said she was not wearing a helmet.

"I was in a coma for nine days," said Bartlett.

She survived but was scarred for life.

"My personality changed. I was moody. My grades went downhill," Bartlett said.

She began having seizures each month. By the time she was 25, she was diagnosed with epilepsy.

"I would love for this never to happen to me," Bartlett said.

She can't change that, but she is trying to change the fate of other children who ride bicycles unprotected.

"In an hour, at least 50, 60 kids go to the emergency room due to bicycle injuries," said Ivonne Anton with the Epilepsy Foundation.

Bartlett has partnered with the Epilepsy Foundation. Together, they are using the $250,000 donated by the Department of Transportation to give away helmets to the community.

"The goal is to distribute about 42,000 helmets throughout the state of Florida," said Anton.

Experts said protecting the brain is critical.

Bartlett is taking the message one step further. She said she warns every child she sees on a bicycle in the hope of preventing them from suffering as she has.

"I say, 'You should get a helmet,'" Bartlett said.

Woman Dies In Florida Car Accident After Car Goes Into Canal In Pembroke Pines

Despite firefighters' frantic efforts to pull a driver out of her partially submerged car, the woman died in the hospital from her injuries, officials said Sunday.

The accident in the 9200 block of Taft Street was reported about 5 a.m. Sunday. The woman was driving a 2005 white Ford west on Taft when her car veered off the road and crashed into a traffic sign, according to Pembroke Pines police.

Then the Ford struck a guardrail and landed on its right side on a canal embankment.

Firefighters arrived to find the front of the car in the water, said Pembroke Pines Fire Rescue spokesman Tom Gallagher.

The driver was never underwater. Crews managed to extract her from the car and took her to Memorial Regional Hospital in Hollywood. Later Sunday, she died from her injuries, police said.

Authorities are not releasing the victim's name until her family can be notified. Speed appears to have been a factor in the crash, which is under investigation, police said.

Fatal South Florida Car Accident Closes Turnpike Lanes Near Delray

All northbound lanes of Florida's Turnpike were closed for three hours Sunday after a vehicle flipped, sending four people to the hospital and possibly causing a death, according to the Florida Highway Patrol.

The accident occurred about 3:30 p.m. just south of Atlantic Avenue on the turnpike, in the northbound lanes west of Delray Beach, state troopers said. The road reopened about three hours later.

Four people were flown to the hospital as trauma alerts, troopers said, and a fifth victim may have been killed in the crash.

This accident is still under investigation.

Settlement Reached In Wrongful Death Case Against Toyota

An out of court settlement has been reached in the Toyota wrongful death case that brought national attention to Toyota's products liability issue, and also spurred the recall of over 8 million Toyota vehicles. The deaths brought national attention to the potential that a driver-side door mat could trap the accelerator pedal, causing deadly sudden acceleration problems.

The New York Times quotes the only statement given by Toyota on the confidential settlement, “Through mutual respect and cooperation we were able to resolve this matter without the need the for litigation.” The 2009 San Diego crash killed off-duty California Highway Patrol Officer Mark Saylor, his wife, their daughter, and his brother in law. The family was driving a Lexus (on loan while Saylor's car was in the shop) when the luxury vehicle suddenly and uncontrollably accelerated to 120 miles per hour before crashing into another car, and ultimately landing in a ravine. Moments before the crash, Saylor's brother-in-law, Chris Lastrella, was on the phone with 911 detailing the scary ordeal.

The Toyota wrongful death case was just against the car company, and the settlement does not cover a similar suit the families have against the local dealership that loaned Mark Saylor the car. In addition to sudden acceleration problems caused by the door mat, there was also a recall for defective pedals believed to be responsible for similar sudden acceleration problems.

The recent settlement may be the first of many for Toyota. Since the Saylor crash, there have been 93 deaths linked to some type of Toyota acceleration defect. In addition to paying a fine of $16.4 million to the government for failing to initiate the recall in a timely manner, Toyota is also defending itself against a sizeable class action over injuries and deaths related to the various defects.

Destin Man Charged After Striking Bicyclist In Florida Car Accident

A Destin man has been charged with leaving the scene of an accident after hitting a bicyclist on the Mid-Bay Bridge on Thursday evening.

Douglas Wayne Rutledge, 30, of Destin was charged with leaving the scene of a traffic accident with injuries and failing to drive in a single lane after an accident that sent one to the hospital.

Rutledge was driving southbound on State Road 293 on the Mid-Bay Bridge around 5:30 p.m. when he dropped a lit cigarette and bent down to pick it up, according to a Florida Highway Patrol media release.

As he was bending down, Rutledge told troopers he drifted into the paved shoulder and the passenger-side rear view mirror hit 71-year-old Berthold W. Schliesing, causing him to be ejected from his bicycle.

According to witnesses, Rutledge stopped and got out of his 1997 Sierra GMC following the collision and spoke to another driver in a silver vehicle. After a brief conversation, Rutledge fled the scene.

Schliesing was found on the north side of the bridge in the southbound lane with what appeared to be ahead injury and a laceration to his abdomen, said North Bay Fire Department spokesman Butch Parker.

Traffic on the bridge was blocked while a medical helicopter landed to pick up the Niceville man and transport him to Sacred Heart Hospital in Pensacola.

Schliesing is listed in serious condition at Sacred Heart Hospital in Pensacola.

“He appeared to be in pretty bad shape,” said Okaloosa County Sheriff's Department spokeswoman Michele Nicholson.

Both southbound and northbound traffic was halted following the wreck, Nicholson said. The bridge was opened back up as of 8:30 p.m.

Witnesses provided a detailed description ofthe vehicle and deputies from the Okaloosa County Sheriff's Office located the vehicle.

The Florida Highway Patrolmatched the damage on the truck with the accident and are investigating.

Rutledge, the registered owner of the truck, was contacted and told troopers he had left the scene but didn't know he had hit anything.

Man Killed In One-Vehicle Florida Car Accident On I-4 Near Polk Parkway

The Florida Highway Patrol is investigating the death of a driver who was killed early Thursday when his truck ran off Interstate 4 and crashed near the Polk Parkway.

According to the FHP, the man, whose identity had not been determined, was driving a 2003 Ford Ranger east on I-4 at 4:03 a.m.

As he approached the Polk Parkway, the truck traveled onto the south shoulder of the interstate and collided with a metal guardrail, a report on the crash said.

The vehicle struck a utility pole, overturned into a ditch and caught fire. The driver was declared dead at the scene.

Officials said they were unsure if the driver was wearing a seatbelt.

Officials are asking for help identifying the man. The FHP said he was Hispanic.

Student In Critical Condition After Florida Car Accident In North Jacksonville

A 14-year-old student was injured about 7 this morning in an automobile accident on New Berlin Road near Moose Road in North Jacksonville.

Duval County school district officials confirmed it was near a bus stop that goes to First Coast High School. Fire officials said the boy was transported in critical condition to Shands Jacksonville hospital.

Lt. Danny Adams of the Jacksonville Sheriff's Office traffic homicide unit said the driver was coming westbound on New Berlin and hit the boy. He said he couldn't go into specifics just yet because the investigation is still preliminary. So he couldn't confirm whether the student was waiting for a bus or crossing the street.

Alex Thayer, 15, said she called 911 after seeing the boy trapped under the car as she was walking to the school bus stop. She said she's had the same route since the fourth grade and doesn't like where the bus stop is located.

"I don't like the road at all," she said. "It is way too dangerous."

Neighbors also said morning traffic there is a problem on weekdays.

The driver remained at the scene but was unavailable for comment.

Pedestrian Seriously Injured In Florida Accident On S.R. 50 In Christmas

A pedestrian has been seriously injured after being struck on State Road 50 in Christmas.

The incident happened near Sabal Palm Drive just after 7 a.m., according to the Orange County Sheriff's Office.

The man was crossing the eastbound lanes of S.R. 50, said Sgt. Kim Montes of the Florida Highway Patrol.

Troopers are currently interviewing the driver of the vehicle to find out what happened, Montes said.

South Florida Accident Involving Broward Transit Bus And Bicyclist Sends Three To Hospital

Three people were taken to the hospital Thursday evening after a crash involving a Broward County Transit bus, according to Fort Lauderdale Fire-Rescue.

The crash happened in the 2900 block of Davie Boulevard shortly after 6 p.m.

The bus had struck a high school football player who was riding in the bicycle lane, WSVN-Ch.7 reported. The teenaged boy is expected to be OK but suffered some broken bones, the station reported.

The conditions of the other two people injured were not available Thursday night.

The injured were taken to Broward General Medical Center.

Fatal South Florida Car Accident Near West Palm Beach

One person is dead and three more are in the hospital after a truck ran over the back end of a Mazda sedan Friday morning at State Road 7 and Southern Boulevard,Palm Beach County sheriff's spokeswoman Teri Barbera said.

Both vehicles were westbound on Southern Boulevard approaching the S.R. 7 exit ramp when the crash happened at 5:53 a.m., Barbera said. One person died at the scene. The others were taken to Palms West Hospital, but one of those injured is being transferred to St. Mary's Medical Center's trauma unit, she said.

While Southern remains open, drivers may wish to avoid the area, using Belvedere Road to get to S.R. 7.

Hit And Run Florida Car Accident Sends Four To Hospital

Four people, including two children, were taken to a hospital after a four-vehicle wreck Wednesday evening.

Rescuers found a Jeep Cherokee, a Honda CRV and a Volkswagen Jetta on U.S. Highway 90 just west of Cavalier Drive about 6 p.m., North Okaloosa Fire Chief Ed Cutler said. The drivers of the vehicles and other witnesses told firefighters that a red Chevrolet pickup also involved in the accident fled the scene.

The driver of the Volkswagen and the driver and two children in the Jeep were taken to North Okaloosa Medical Center, Cutler said. Their injuries did not appear to be life-threatening.

Eastbound traffic on U.S. 90 was shut down for about 45 minutes while crews cleared the wreckage, Cutler said.

It was not known Wednesday night how the accident occurred. The Florida Highway Patrol was investigating the crash and Okaloosa County sheriff's deputies were searching for the hit-and-run driver.

Motorcyclist Critically Injured In Florida Accident

A motorcyclist was critically injured early Thursday morning when he plowed into the back of a Dodge Caravan on Interstate 75 near the State Road 40 exit.

The motorcyclist, Robert Kelly, 22, of Silver Springs, was taken by helicopter to Shands at the University of Florida in Gainesville.

The 2:20 a.m. wreck closed a northbound section of I-75 for a couple of hours. Law enforcement officials detoured traffic at the State Road 200 interchange while Florida Highway Patrol troopers investigated the crash.

Roughly two hours after the accident, officials opened two lanes of the busy Interstate.

Troopers said the 2005 Dodge Caravan was heading north in the center lane when a 2002 Suzuki motorcycle crashed into the rear of the minivan. The rider was thrown forward into the middle of the other vehicle.

Troopers said speed may have been a contributing factor in the crash.

The motorcycle rider, who was wearing a helmet, was flown out in critical but stable condition.

"We were just cruising in the center lane, when we heard a big ole bang and he's lying between us," said Sammy Cannon, who was sitting with his wife, Nicole Cannon, in the back seat of the minivan.

Driver Jeff Stark said the vehicle shook suddenly about half of a mile from the SR 40 exit, and it sounded like "the back tire blew out."

Because other vehicles were behind them, Stark said, he slowed down and pulled over on the shoulder 70 to 80 yards past the SR 40 exit.

"I turned around and saw a guy's head was turned liked he was looking out the passenger's window," Stark said. The injured man was breathing.

Traveling in a Chevy Malibu in the middle lane not far behind the minivan were Charles Johnson and his wife, Dachari Walker-Johnson. He said they were going about 65 mph when the motorcyclist "shot past them" in the far lane.

The couple said they head a boom and then saw a cloud of smoke and bike pieces flying everywhere.

"He was going so fast he didn't see that van," Dachari Walker-Johnson said.

The Walkers said they stopped and called 911. Thinking the motorcyclist must have been thrown from his bike onto the roadway, Johnson searched the area but found nothing.

He said they then drove farther down the road and saw the Dodge Caravan parked on the shoulder. At that time, he said, they saw the rider in the back of the minivan.

"He was breathing a little bit," Johnson said.

Middleburg Man Critically Injured In Florida Motorcycle Accident

A Middleburg man suffered critical injuries Thursday morning after the motorcycle he was riding flipped on Orange Park Northway, the Florida Highway Patrol said.

Wayne A. Duve, 24, was traveling southwest when, for unknown reasons, he lost control of the motorcycle, the report said. The motorcycle struck a curb, flipped and struck several trees. Duve was thrown off onto the road.

He was taken to Shands Jacksonville hospital, the Highway Patrol said.

The crash is alcohol-related, and Duve was not wearing his helmet, according to the report.

Florida Man Settles McDonald's Suit Over Hot Sandwich

A Florida man has settled his $2 million lawsuit against a McDonald's restaurant in southwest Virginia that allegedly served him a chicken sandwich that exploded with hot grease.

Terms of the settlement entered on September 17 in Alexandria were not disclosed.

The long-running case began in 2005 when carnival operator Frank
Sutton of Brooksville, Fla., ordered a fried chicken sandwich at a
McDonald's in the Daniel Boone truck stop in Duffield, Va. He said
he suffered burns to his mouth and lips when it spewed scalding
grease after he bit into it.

A judge dismissed the lawsuit in 2008, saying that Sutton should
have tested the temperature of his sandwich before ate it. But a
federal appeals court disagreed and sent the case back for a second
trial. That trial had been scheduled to start next week.

Deputy Injured In South Florida Motorcycle Accident

A Broward Sheriff's deputy was injured Thursday morning in a crash in South Miami-Dade.

The deputy was riding a motorcycle when he was hit by a car making a left turn at the intersection of Coral Reef Drive and 117th Avenue.

Sky 10 was over the scene at just after 6:30 a.m. There were major backups as flares blocked traffic at the intersection. The images from Sky 10 also showed the motorcycle on its side, the car was off to the side with some front end damage.

The deputy was transported to Jackson South, but only suffered minor injuries. The driver who struck the deputy remained on the scene.

The investigation into the accident continues.

Miami School Bus Driver Trapped In South Florida Car Accident

A Miami school bus driver is trapped, following an early-morning crash Thursday.

The crash happened along 62nd Street and Northwest 11th Avenue.

Miami police said the driver was feeling sick and hit a tree while pulling over to the side of the road.

Miami Fire Rescue workers were able to pull the driver, who was pinned under the dash board, out of the bus.

The driver was transported to the Ryder Trauma Center at Jackson Memorial Hospital.

No children were on board at the time.

3 Injured In Florida Car Accident Involving Lakeland Police Officer

A Lakeland police officer and two other drivers were injured Tuesday evening when they collided near downtown.

All three were taken to Lakeland Regional Medical Center with non-life-threatening injuries, according to a release by Lakeland police Sgt. Terri Smith.

Officer Ronald Rose was driving his 2006 Ford squad car north on Massachusetts Avenue about 7 p.m. when he collided with a 2006 Toyota driven by Javed Bailey, 26 of Lakeland, which was heading west on the In-Town Bypass, Smith wrote.

Rose was driving to the scene of another accident and was using his lights and siren, the release said. After the initial impact, Rose's car hit a 2007 Dodge driven by Valarie Payne, 46, of Lakeland.

The wreck involving Rose was still under investigation as of noon Wednesday, and no citations had been issued, according to Smith.

Hillsborough Deputy Killed In Florida Car Accident In Downtown Tampa

A Hillsborough County sheriff's deputy was killed early Tuesday in a downtown crash with a semitrailer truck driven by a Davenport man, officials said.

Deputy Mark A. Longway, a 48-year-old married father of two, was heading north on Florida Avenue, and the semi was heading east on Scott Street, said Chief Deputy Jose Docobo. The two vehicles collided about 5:20 a.m. in the intersection near an interstate overpass, he said.

'Obviously, one of the vehicles had a red light,' he said, but authorities did not immediately say who was at fault.

Longway's car wound up wedged beneath the semi about 100 feet from the intersection.

Nearly four hours after the crash happened, a large crane arrived and lifted the back of the semi. The scene where Longway was removed was covered by a green tent.

Longway was remembered by co-workers as a family man and enthusiastic deputy with a joy for life that was infectious.

Deputy Bill Stark, who worked with Longway, said Longway was a grandfather who loved riding his black Harley with his wife.

One time, at the end of Stark's shift, he recalled, Longway was making a routine traffic stop. He had pulled over a habitual offender and Stark rolled up to assist with the arrest.

But it was clear Longway had it under control. By the time the man was in the deputy's cruiser, Longway already had him laughing.

'He could take a bad situation, turn it around, and have them laughing,' Stark said.

The truck driver involved in Tuesday's crash, Lamont Ashley, 39, of Davenport, was not injured, Docobo said, and traffic homicide investigators were at the scene for several hours.

Deputies have found no indication that the cruiser's emergency lights were on, he said.

The crash prompted a large response, with at least a dozen police and sheriff's cars and three Tampa Fire Rescue trucks.

'It's always something that affects everybody in law enforcement,' Docobo said of the crash. 'It's very difficult.'

Longway was a 21-year veteran who worked port security detail, officials said. In April 2008, he was named in a St. Petersburg Times report as one of three deputies who helped rescue a man threatening to jump from atop a building on Fletcher Avenue.

A year earlier, he had saved another man who was threatening to jump from the overpass of Dale Mabry at Busch Boulevard, the Sheriff's Office said.

According to a 2007 North Tampa Chamber of Commerce newsletter, he was named Law Enforcement Officer of the Month in June that year, praised for his work in thwarting a burglary in progress at the Northdale Golf and Tennis Club.

Orlando Man Died In Florida Car Accident In Osceola

An Orlando motorist died Tuesday afternoon in a 4-car collision on Narcoosee Road, according to the Florida Highway Patrol.

Jessie Melendez, 55, was driving southbound on the Osceola county roadway when she swerved into the path of three northbound vehicles, FHP Sgt. Kim Montes wrote in a crash report released late Tuesday.

The driver of the first northbound vehicle drove off the road to avoid a crash and struck a stop sign at the corner of Narcoossee Road and Redd Lane, the report stated.

Melendez's 2001 Honda compact then crashed head-on into the front of the second northbound vehicle, a 2007 Buick SUV driven by Pamela Holasek, 41, of St. Cloud, who admitted in serious condition to Orlando Regional Medical Center, the report stated.

The third northbound vehicle, a 2009 Dodge van driven by Nicholai Menkin, 27, of Winter Park, swerved to avoid the crash but struck the rear of Holasek's vehicle. He was uninjured, the report stated.

All four motorists were wearing seatbelts.

Melendez was pronounced dead at St. Cloud Hospital. Troopers were unable to determine what caused her to veer into oncoming traffic.

Injury In South Florida Car Accident on I-95

All lanes of southbound Interstate 95 near Sample Road have reopened after a three-vehicle crash involving a tractor trailer snarled traffic for more than an hour.

The crash, which was reported shortly after 7:30 a.m., involved a tractor trailer, a truck and a landscaping vehicle pulling a trailer loaded with lawn mowers and other equipment, said Sgt. Mark Wysocky of the Florida Highway Patrol.

One person was injured, but not seriously, Wysocky said

The collision left only one of the southbound lanes open just north of Sample Road. It caused traffic backups approaching the Palm Beach County line until 9 a.m., when the lanes were reopened.

SUV Drives Into Business In Florida Car Accident And Flees

Ray Marks, owner of Accent Tops & Trailers, woke up around 3:30 a.m. Tuesday to the Florida Highway Patrol calling to tell him his business was in need of immediate service.

Around 2 a.m. an unknown person driving a dark colored SUV was traveling south on Beal Parkway when they crossed over the median and ran directly into Accent Tops & Trailers.

The driver reversed out of the building and fled before troopers arrived, according to an FHP media release.

“We've got a mess to clean up,” Marks said Tuesday morning. “He destroyed a lot of inventory and the roof is about to cave in.”

Marks estimated damages to the business at around $35,000 to $40,000 dollars.

He said after the insurance company did their estimates he would be working to secure the building's gaping hole that faces Beal Parkway.

“Look at it,” he said. “Anyone can walk in here and take stuff. Although, most of it's rubble now.”

Marks has owned the building since 1988. He said prior to his owning the shop, the building had been hit three other times by drivers traveling on the roadway.

After some initial cleanup, Marks said he has already found parts of the vehicle responsible for the damage, but is willing to offer a reward to anyone that can help to locate the person responsible.

“I'm offering a $1,000 reward for anyone that has information that will help us find the guy that did this,” he said. “We've already found parts of the car and we will get him. But if anyone can help, I want to know.”

FHP is investigating the case.

Single Vehicle Fatal Florida Car Accident In Valdosta

On September 21, 2010, 25 year old male, Shannon Holsendolph, resident of Brooks County was involved in a single vehicle traffic accident on North Forrest Street between East Brookwood Place and Lausanne Drive. Holsendolph was driving a 2002 Pontiac Grand Prix when it appears he lost control of the vehicle, ran off the road, over-corrected the vehicle and struck a light pole and flipped the vehicle. The vehicle came to rest in the back yard of a residence in the 800 block of Lausanne Drive. Holsendolph was pronounced deceased at the scene of the wreck. Holsendolph was the sole occupant of the vehicle and was not wearing his seatbelt.

The Valdosta Police Department Traffic Unit is currently investigating the accident, the cause of the accident, and any contributing factors

Police Say Grandfather Accidentally Ran Over Baby In South Florida Car Accident

A toddler whose mother said he had been run over by a car with an unknown driver was hit by the child's grandfather, said a police spokesman.

At 12:42 p.m. Monday, rescue crews were called to the incident in the 4600 block of Southwest Alpha Street, according to St. Lucie County Fire District spokeswoman Catherine Chaney.

Initially the child's mother, Frantzcesse Novembre, reportedly in her late 20s, told police she went to a car to get something and 18-month-old Quintone Flemming followed her out, said Port St. Lucie Police Officer Tom Nichols.

When she returned to the house, Novembre told police, the boy was missing so she went outside to look for him and saw that he had tire marks on his shirt and abrasions on his face, arms and neck, Nichols said.

Later during the investigation, police said the boy's grandfather Jacques Novembre had been unaware that the boy had followed him out to the driveway. Nichols said the boy fell down in the driveway, where Jacques Novembre, reportedly in his late 50s or early 60s, was moving vehicles. After moving the vehicles, the grandfather found the toddler on the ground crying. He took the boy inside for the child's mother to care for him, and he left for work.

While investigating the incident, police compared tire marks found on the boy's shirt with the tires on the four vehicles parked at the home. The make and model of the vehicle was not available.

As of Monday evening, the child was at St. Mary's Medical Center in West Palm Beach with injuries that were not considered life-threatening, Nichols said.

No one has been arrested or charged in the incident, Nichols said.

"It was an unfortunate accident," he said. "There was no malice or ill intent involved."

Investigators Seek SUV That May Be Linked To Fatal South Florida Car Accident

Investigators say a second vehicle may have been present last week when a Nissan Altima lost control on Okeechobee Boulevard and crashed through the storefront of The Flooring Giant, killing one person and critically wounding another.

A dark SUV was seen traveling near the Altima when it crashed into the store west of West Palm Beach early Thursday, according to the Palm Beach County Sheriff's Office.

It was not immediately clear whether the SUV was believed to have any involvement in the crash.

The Altima barreled into the store, 2522 Okeechobee Blvd., shortly before 6 a.m. Both passenger and driver were thrown from the vehicle.

William Espinoza, 19, of West Palm Beach, was declared dead at the scene, and Carlos Arce, 17, of Lake Worth, was hospitalized with critical injuries. It remains unclear who the driver was.

The crash is still under investigation.

Eleven Year Old Pedestrian Suffers Minor Injuries In South Florida Accident With Car

An 11-year-old girl is expected to be released from the hospital after she was struck by a pickup Tuesday morning on East Atlantic Boulevard, the Broward Sheriff's Office said.

The child, Brenda Woolley, had minor scrapes, some pain and tenderness and was taken to Broward General Medical Center, the Sheriff's Office said.

At about 8:30 a.m., Woolley "darted into" the 400 block of East Atlantic Boulevard in an area without a crosswalk, where she was struck on her left side by a vehicle eastbound on Atlantic. Woolley landed on the median.

She was unconscious when paramedics arrived but then woke up, said Sandra King, spokeswoman for Pompano Beach Fire Rescue.

The Sheriff's Office said she is expected to be released from the hospital, but it was unclear when.

A school resource deputy at Pompano Beach Middle School also responded to the accident and plans to educate students about the proper way to cross streets. A pedestrian crosswalk with two crossing guards was less than 1,000 feet west of where Woolley was struck.

The driver, Tammy Lynn Good, 39, a Pompano Beach resident who works for the city as an engineer, was in her personal vehicle at the time of the crash. Visibly shaken, she remained at the site to wait for paramedics and deputies to arrive, King said.

Woolley was headed north, with only four blocks left to go before reaching her middle school, at 310 NE Sixth St.

The Sheriff's Office said no charges were anticipated.

U.S. Governent Says Distracted Driving Car Accident Deaths Fell In 2009

The government says the number of people killed in crashes connected to driver distraction fell last year but still remain an epidemic.

The Transportation Department said Monday that 5,474 people were killed in 2009 in crashes reported to have involved distracted driving, a 6 percent decline from the more than 5,800 people killed in 2008.

Distraction-related deaths accounted for 16 percent of all traffic fatalities in 2009, the same percentage as in 2008.

Transportation Secretary Ray LaHood says the problem is still an epidemic and the data could be the "tip of the iceberg." He says many police reports don't document whether distraction was a factor in vehicle crashes.

LaHood is kicking off a second summit on distracted driving Tuesday.

Lakeland Bicyclist Struck And Killed In Florida Accident On U.S. 98 North

A Lakeland bicyclist was killed early Sunday in an accident on U.S. 98 North in North Lakeland, the Florida Highway Patrol reported.

David Rife, 62, was riding south on the inside lane of U.S. 98 North north of Duff Road about 3 a.m. The rear of his bicycle was struck by a southbound 2001 Dodge sport utility vehicle driven by Kyle Brown, 22, of Plant City, the FHP said.

Rife, who was not wearing a helmet, was thrown into a grassy median, troopers reported.

Brown kept going south on U.S. 98 and later called troopers from his Plant City home, saying he was worried that he had hit someone, troopers reported.

No charges have been filed as the investigation continues.

Interlachen Motorcyclist Seriously Injured In Florida Car Accident

An Interlachen motorcyclist were seriously injured during a Sunday evening crash after a truck apparently pulled out in front of him.

Justin B. Coates, 23, was flown to Shands at the University of Florida in serious condition following the crash at about 7:30 p.m. in Putnam County. According to the Florida Highway Patrol, Coates had been driving a 2005 Kawasaki motorcycle.

The other driver involved, Courtney Adams, 17, of Palatka, was not injured. He was driving a 2000 Ford pick up at the time of the crash on State Road 20 at Francis Church Road in the Francis community of Putnam County, said FHP Sgt. D.E. DuPont.

According to DuPont, Adams was southbound on Francis Church Rd. and began crossing S.R. 20 into Coates' path. Based on statements from witnesses and evidence at the scene, DePont said it appeared that Coates swerved to the left in an attempt to avoid the crash but the front of the motorcycle hit the back of the pick up while both vehicles were in the paved median.

Charges were pending further investigation, DuPont said.


Crawfordville Man Killed In Florida Car Accident

A 22-year-old Crawfordville woman was charged with DUI Manslaughter Friday, Sept. 17 in the Sept. 10 traffic crash that claimed the life of her 23-year-old companion, according to Sheriff David Harvey.

Jessica Marie Bouchard Kelley was booked into the Wakulla County Jail following the conclusion of investigation by the WCSO Traffic Unit.

Marcus Brandon Kelley was killed in a traffic accident on Highway 375 near Piney Creek Road north of Smith Creek in western Wakulla County.

Evidence collected during the investigation was consistent with Bouchard Kelley being behind the wheel when the fatal crash occurred. She is being held in jail with no bond.

Marcus Kelley was ejected from the truck after it left the highway four miles south of the Leon County line. The 2001 Chevrolet pickup truck was southbound when it left the road and struck a guardrail south of Piney Creek Road.

The victim died at the scene at 1:28 a.m. The investigation determined that the traffic accident was alcohol related. It is the second traffic homicide of the year in Wakulla County.

The accident was investigated by Deputy Dale Evans, Captain Billy Jones and Deputy Ben Steinle of the WCSO Traffic Unit and Lt. C.L. Morrison and Deputies Ward Kromer and Rachel Oliver of the Road Patrol unit.

Police Say Bicyclist Killed In South Florida Car Accident In Boynton Beach After Being Hit By Jetta

A bicyclist was struck and killed this evening by a vehicle on Boynton Beach Boulevard, causing the road to be shut down while police investigated.

The biker was struck about 6 p.m and died from his injuries, Boynton Beach police spokeswoman Stephanie Slater said.

The victim, who was in his early 20s, was riding on a motorized three-wheel bicycle. He was hit by a silver Volkswagen Jetta. The driver of that vehicle was not injured.

All lanes of Boynton Beach Boulevard were shut down between Old Boynton Beach and the Palm Beach Leisureville east of Congress Avenue.

The roads reopened by 9:40 p.m.

Two Dead And Six Injured In I-95 South Florida Car Accident Involving A Rollover

A rollover accident on Interstate 95 on Saturday morning killed two Miami residents, injured six others and shut down northbound lanes for three hours.

Passengers Antonio Moreno, 47, and Tania P. Gutierrez, 39, were killed. The driver, Hugo E. Fernandez Muro, 46, suffered minor injuries.

They were traveling north in a 2004 Chevrolet Tahoe just south of Sunrise Boulevard when the driver lost control of the vehicle around 10 a.m., according to the Florida Highway Patrol. Highway Patrol spokesman Sgt. Mark Wysocky said the agency is interviewing witnesses to find out what happened.

"We know the driver lost control," he said. "We're still trying to figure out if a second vehicle was involved."

Five people were ejected from the vehicle as it turned over and came to rest about 100 yards from the Sunrise exit. One victim was pronounced dead at the scene, and the other died at Broward General Medical Center.

Moreno was wearing a seatbelt, but Gutierrez was not, according to the accident report. Troopers said alcohol was not a factor.

Two of the injured were listed in critical condition: Yasmany Gonzalez, 23, and Vivian Fernandez, 47. Two more were in serious condition: Leyanis Orellana, 17, and Diana Fernandez, 18. A 5-year-old child, Dayania Fernandez, has minor injuries.

All are from Miami.

All of I-95's northbound lanes were closed near the Broward Boulevard exit until around 1 p.m. The Andrews Avenue drawbridge was temporarily closed to boat traffic so the five ambulances could take the victims to Broward General.

Seminole County Deputy Involved Chase That Ends In Florida Car Accident In Orlando

Seminole County officials are investigating a deputy-involved chase that ended when a van crashed in Orlando.

Deputies said they were chasing the van sometime around 5:30 a.m. after a check on the plate showed it had been reported stolen.

Officials used stop sticks to disable the vehicle, which stopped on a grassy area on Princeton Street just off Interstate 4.

Sheriff's deputies arrested three people who were inside the vehicle.

Five People Injured And Taken To Hospital After Florida Car Accident In Jacksonville

Five people had to be taken to an area hospital after Thursday morning's crash at Southside Boulevard and Ivey Road, Times-Union news partner First Coast News reports.

The 8 a.m. incident occurred when a car stopped at the traffic light was struck by another car from behind, according to the news report. The initial crash affected three other vehicles as well, and a fire destroyed one car and caused damage to two others. All southbound lanes were closed and traffic was rerouted onto the service road until shortly before 11 a.m.

Police Say Driver In Accident Using GPS When Bus Hit Bridge

Authorities say the driver of a double-decker bus was distracted by his own GPS when he drove the vehicle into a railroad bridge in central New York, killing four passengers.

Onondaga County Sheriff Kevin Walsh tells the Post-Standard of Syracuse and WSTM-TV that 59-year-old John Tomaszewski (tom-uh-ZOO'-ski) was using his personal GPS device and not the system installed on Megabus when it hit the bridge early Saturday.

Walsh says investigators are trying to determine whether Tomaszewki was holding the device or listening to it at the time of the crash.

Police say the bus was too tall to clear the bridge's low-hanging span.

Officials say Tomaszewki hit the bridge after making a wrong turn off Interstate 81. He has been released from the hospital.

Family Of 5 Injured In Florida Car Accident On U.S. 98

A father, mother and their three children were all injured after the sport utility vehicle they were riding in crashed into three vehicles, flipped and landed on its roof Thursday afternoon.

The family of five was headed westbound in a 2002 Ford Expedition on U.S. Highway 98 around 1 p.m. Thursday when they approached the State Road 87 intersection, according to the Florida Highway Patrol. The driver, 34-year-old Danny Hendricks, failed to stop at the red light.

Douglas Degeal, 44, of Wentzville, Mo., received a green light to turn left from southbound S.R. 87 onto U.S. 98, an FHP news release said. After failing to stop, Hendricks attempted to swerve around Degeal's 2007 Subaru sedan but crashed into its left side.

Hendricks' SUV was “propelled” onto its left two wheels, continued forward and struck two vehicles stopped in the oncoming left-hand turn lane, a 1995 Isuzu SUV driven by 55-year-old Sheila Powell of Shalimar and a 2002 Toyota pickup driven by 48-year-old Terry Broxson of Navarre, the release said. The Ford rolled over on its right side and came to a rest on its roof.

“It's flattened out pretty good,” Holley-Navarre Fire Chief Ron Norton said of the Ford.

All five of the family from Melbourne, Fla., crawled out of the vehicle, but Danny Hendricks passed out at the scene, Norton said. He was considered a trauma alert and driven to Baptist Hospital in Pensacola with serious injuries.

The mother, 32-year-old Christine Hendricks, and three children, aged three, seven and 10, were taken to Gulf Breeze Hospital after suffering minor injuries, Norton said. The woman told responders that she remembered traveling through a yellow light just before the accident.

None of the other people in the other three vehicles were injured, the FHP release said. Everyone involved was wearing a seat belt, and alcohol was not a factor in the crash.

Both lanes of U.S. 98 were shut down at the intersection for almost an hour and a half, Norton said. Traffic was diverted through parking lots and side streets.

Danny Hendricks faces a charge for failing to obey a traffic signal.

'Car Surfing' Teen Injured In Florida Car Accident Still In Serious Condition

Police have identified the 17-year-old boy who was run over by a pickup truck while “car surfing” Wednesday afternoon. They aren't sure whether he'll make a full recovery.

Eric Russell Arden of Crestview was seriously injured after he fell off the hood of a white Dodge Ram pickup truck driven by 17-year-old Thomas Garrett Carrico, also of Crestview, according to a news release from the Crestview Police Department. Arden was flown to Sacred Heart Hospital in Pensacola, where he remained in serious condition Thursday.

About 4 p.m. Wednesday, Arden was riding on the truck's hood on Northview Drive near the entrance of Countryview Park when Carrico began to brake, the release said. Arden “lost his grip of the hood,” slid off of the front and under the truck, according to police. He was dragged about 27 feet.

Arden suffered a compound fracture to his right arm and road rash to his chest, Lt. Andrew Schneider said. Rescuers weren't sure whether he suffered internal injuries.

Several people at the park witnessed Arden "car surfing," along with a teenage girl in the passenger seat of the pickup who Schneider said wasn't involved in the incident.

Carrico has been cited for allowing a person to ride on the exterior of a vehicle and Arden will be cited for riding on the exterior of a vehicle, Schneider said.

Additional charges for Carrico and Arden will depend on the extent of Arden's injuries and whether he suffers a permanent disability or makes a full recovery.

“Right now we just don't have enough to determine what his long-term health is gonna be, how it's gonna be affected,” Schneider said Thursday.

Police have 30 days to finish the investigation and decide on charges.

Teen Bicyclist Struck By BSO Squad Car In South Florida Car Accident

A Broward Sheriff's Office unit struck a teenager on a bicycle early Friday when the boy attempted to cross a Weston road against the traffic signal, according to BSO.

The incident happened shortly after 7:30 a.m. near Glades Parkway and State Road 84.

According to BSO, the teen, a boy believed to be 15 or 16, was riding south on Glades Parkway and trying to cross SR 84 during a red light when he was struck by a BSO squad car.

The teen was conscious and breathing when he was airlifted to Broward General Medical Center, BSO said.

Traffic in the area of SR 84 and Glades Parkway is being restricted as the investigation takes place.

Boca Raton Man Critically Injured After Truck Flips Over In South Florida Car Accident On I-95 In Boynton

A 58-year-old man is in critical condition after a Thursday morning crash on Interstate 95 in Boynton Beach, authorities said.

The accident happened around 9:45 a.m. in the northbound lanes of I-95, just south of Gateway Boulevard, according to the Florida Highway Patrol.

Erskin Jackson, of Boca Raton, veered his 2001 Ford truck across several lanes to avoid hitting traffic that slowed ahead of him. Instead, his truck hit a 2007 Mazda SUV and flipped over several times, throwing Jackson from the vehicle.

He was not wearing a seatbelt, FHP said.

Jackson was taken to Delray Medical Center in critical condition.

James Winner Marketer Of The "Club" Dies in Car Accident

James Winner, who marketed the steering-wheel lock known as The Club after his car was stolen in the 1980s, has died in a head-on collision in western Pennsylvania. He was 81.

Two other people also died when Winner's sport utilityvehicle crossed into oncoming traffic Tuesday "for unknown reasons" and collided with their car, State Police said. The investigation continued.

Winner sold the first Club in western Pennsylvania before creating Winner International, the Sharon-based company that has now sold more than 10 million units. The device prevents car thieves from driving away - and its visibility can be a powerful deterrent in itself.

In a statement Wednesday, company officials said it was "a very difficult time for all of us and the family would request that you honor their privacy."

He also was widely known for his philanthropy in western Pennsylvania. He said he wanted to make the area a tourist destination and create jobs after industry losses there.

He bought and restored buildings, including the downtown Sharon home once owned by industrialist Frank Buhl, which Winner converted into a bed and breakfast. Winner owned hotels, schools and businesses, including Winner Steel, which he eventually sold.

"Jim was just a great man and did more behind the scenes than people even knew," the Rev. Larry Haynes, who worked with Winner through the Shenango Valley Foundation community group, told the Sharon Herald.

Winner was born in the town of Transfer and worked on his family's farm from age 5. He attended school in a one-room schoolhouse before joining the Army at age 17. The other two people killed in the crash were identified as driver Bobby Jarrett, 82, of Tionesta, and passenger Raymond Fair, 76, of Tylersburg.

Winner also had a home in Hollywood, Fla.

Various news reports have cited Winner as the inventor of The Club, the U.S. Patent and Trademark office calls him such, but he is more accurately described as the marketer of the device. A series of lawsuits by the device's original inventor, Charles Johnson, came to a head in 1993 when Winner and his company, Winner International Corp., agreed to pay over $10 million in damages. Johnson's suit alleged that he invented the Club and agreed to half of its profits on a handshake deal when Winner began marketing it. He said that Winner did not split the profits with him, giving him an amount below $20,000 despite The Club's success in the U.S. and throughout the world.

FHP Says Injury In South Florida Car Accident That Closes All North Bound Lanes On I-95 Near Gateway

A two-car accident has shut down all northbound lanes of Interstate 95, south of Gateway Boulevard, according to the Florida Highway Patrol.

Though details of the accident are unclear, a silver Mazda and a black sport utility vehicle were involved, said FHP spokesman Lt. Tim Frith. The driver of the SUV was ejected when it overturned, he said.

The SUV, which was traveling north, came to rest facing east about a mile after Boynton Beach Boulevard. Half a mile farther, the Mazda stopped right before Gateway Boulevard.

Frith said the driver of the SUV has been taken to Delray Medical Center in serious condition. He said there are no reports of the Mazda's driver being injured.

All northbound lanes of I-95 are closed and vehicles can only pass through on the left shoulder. The traffic pile-up begins as far south as Woolbright Road.

Within the next 30 minutes, one or two lanes may be opened to allow traffic to pass through, Frith said.

Pedestrian Killed In Apopka In Florida Car Accident

Authorities said a driver struck and killed a pedestrian overnight in Apopka.

Florida Highway Patrol reports show the 46-year-old pedestrian, whose name has not been released, was not using the crosswalk when he was killed.

Officials said Lesbia Mattei Perez was driving her Toyota Corolla on West Orange Blossom Trail, just west of Shepard Avenue sometime around 11:16 p.m.

Reports show the pedestrian was standing on the sidewalk and starting to cross West Orange Blossom Trail when the front of Perez's car struck the left side of the pedestrian.

Troopers said the man died at the scene.

It is unclear if 26-year-old Perez will face charges in the pedestrian's death.

Boy Seriously Injured After Hit By Car In South Florida Accident

An 8-year-old boy is in serious condition after being struck by a car in the Pine Hills area this morning, the Florida Highway Patrol said.

Ramon Belton was walking north, trying to cross Denson Drive, when he was struck by a pickup truck driven by Alisa Owens, 22, of Orlando, an FHP report said.

Owens swerved to try to avoid striking Ramon, but the truck struck the boy, the report said.

Witnesses told troopers Ramon was already trying to cross the road as Owens approached, and she failed to react until just prior to striking the boy.

Owens was cited for careless driving.

Ramon is being treated at Arnold Palmer Hospital.

Woman Hospitalized After South Florida Car Accident With Broward Sheriff Deputy's Car On I-95

A woman was hospitalized early Wednesday after crashing into a Broward Sheriff's Office deputy's vehicle on Interstate 95, authorities said.

The accident happened about 1:30 a.m. in the northbound lanes approaching Congress Avenue, according to the Florida Highway Patrol.

Quisepe Murillo changed lanes improperly and cut in front of the deputy's unmarked vehicle, said FHP spokesman Lt. Tim Frith. The two cars crashed and rolled onto the side of the roadway.

Murillo was transported in stable condition to the trauma unit of Delray Medical Center, according to Boca Raton Fire-Rescue. The deputy, who was off duty at the time, refused treatment.

All lanes through the accident scene reopened about an hour later.

Murillo was faulted in the crash for improper lane change, the FHP said.

No other information was immediately available.

Two Killed In South Florida Car Accident After Car Crashes Into Flooring Store

Two people are dead after a car smashed into a flooring store near West Palm Beach, Palm Beach County sheriff's dispatchers report.

Rescue crews and sheriff's deputies were dispatched shortly before 6 a.m. to the 2500 block of Okeechobee Boulevard, where a car crashed through the front of The Flooring Giant. The store sits next door to a gym between Congress Avenue and the intersection at Palm Beach Lakes Boulevard.

Early accounts indicate the driver was eastbound and thrown from the car when it crashed. A second person at the scene also died, dispatchers report. One lane of Okeechobee is closed while investigators work the scene.

Miami Heat Dancers 'Will Never Forget' Friend Killed In South Florida Car Accident

Nancy Lopez-Ruiz, 22, a new Miami Heat dancer, was looking forward to a poster shoot with her team next week in South Florida.

The 2010-11 promotional poster would have been one of several appearances she made this year after auditioning in July and joining the elite group of 27 dancers.

On Tuesday, four days after Lopez-Ruiz died in a traffic crash, the director of the Miami Heat Dancers remembered the great vitality she demonstrated over the past two months of rehearsals.

"I can honestly say she was the hardest-working dancer on the team this year, and her teammates would agree," said the director, Janine Thompson.

Lopez-Ruiz, who grew up in Bradenton and lived in Plantation, would have started performing for an audience of thousands next month when the NBA pre-season kicks off.

She often showed up early for practice and didn't tire easily, Thompson said. Last Thursday was a good example.

"After working out before rehearsal, she still found the energy to dance full out, with full energy, the entire rehearsal," Thompson said. "She will always be a part of our team, and we will never forget her."

The crash happened at 9:38 p.m. Friday. Lopez-Ruiz was riding her motorcycle west in the right lane of East Sunrise Boulevard, Fort Lauderdale police said.

A 2009 Mercedes that also was heading west on Sunrise veered onto a median in the 700 block, drove back into a westbound lane and struck Lopez-Ruiz's Suzuki GSX-R, police said. The collision threw her from the motorcycle. She was pronounced dead at the scene.

Police are investigating whether the Mercedes' driver, Mario Careaga, 42, of Fort Lauderdale, was driving while impaired, according to Sgt. Frank Sousa, a department spokesman.

The police inquiry, which includes toxicology tests, may take six months to a year, Sousa said.

Careaga could not be reached Tuesday for comment despite phone calls to his workplace.

In recent days, hundreds of people have posted messages about Lopez-Ruiz's death on the Miami Heat's Facebook site.

"Her dream of being a Heat dancer just came true," reads one entry, "and before she could really enjoy the job of her life, something tragic like that had to happen."

Lopez-Ruiz's family scheduled her visitation from 5 p.m. to 8 p.m. Thursday at Brown & Sons Funeral Homes & Crematory, at 5624 26th St. W. in Bradenton. Her funeral Mass will be celebrated at 9:30 a.m. Friday in St. Joseph's Catholic Church, 3100 26th St. W. in Bradenton.

Driver Kills Himself During Florida Traffic stop

A man who had been driving on Interstate 10 in the Florida Panhandle reportedly killed himself during a traffic stop.

The Madison County Sheriff's Office reports that a deputy pulled the man over after receiving a report from the Florida Highway Patrol about a reckless driver. Before the deputy could make contact with the driver, he reportedly shot himself.

The man was pronounced dead at the scene. He was not immediately identified by authorities.

No Injuries In Florida Car Accident On U.S. 98

Three vehicle crashes snarled westbound traffic on U.S. 98 through Gulf Breeze for more than two hours Tuesday morning.

The first crash occurred about 5:45 a.m. in the right lane of the Pensacola Bay bridge headed toward Pensacola when a car rear-ended a Department of Transportation truck. No injures were reported. The second crash, a minor, rear-end collision also with no injures, occurred on the bridge about 8:10 a.m., Gulf Breeze police said.

The third crash, about 8:45 a.m., was in the 1200 block of U.S. 98, just east of Gulf Breeze Hospital, Gulf Breeze police said.

That crash caused only minor damage, and no one was injured.

Hollywood Man Charged With DUI In South Florida Car Accident That Killed His Friend

An 18-year-old man was driving under the influence when he lost control of his car and ran off the highway, causing the vehicle to burst into flames, according to a Florida Highway Patrol report.

The crash killed the driver's best friend, who was in the car with him.

Roee Chai Ben-Amor is charged with three counts of driving under the influence and failing to render aid in the Aug. 27 crash. Ben-Amor, of Hollyowood, turned himself into authorities on Tuesday evening.

"We had reason to believe he was going to flee the county so we were able to get the information we needed expedited a bit," said Mark Wysocky of the Florida Highway Patrol.

According to the FHP report filed in the days after the crash, Ben-Amor and Samuel Gargir, also 18, were out at about 3:15 a.m. on a Friday night when Ben-Amor lost control of his 2007 Kia Optima as he turned onto the Interstate 595 west exit ramp to State Road 7. Ben-Amor hit a pole, and the car burst into flames.

Ben-Amor survived with a broken leg. Gargir died at the scene.

According to friends who posted on a Facebook memorial page for Gargir, he was a football player — a tight end on the Hollywood Hills High team — and an active bodybuilder. He was set to attend florida International University in Miami, friends said.

The weekend of the accident, Ben-Amor's mother, Yaffa Ben-Amor, spoke with the Sun Sentinel and said that her son and Gargir were best friends since they were 2 years old. She said her son told her the roadway was wet when he attempted to turn off I-595. When the car hit the pole, he was thrown through the passenger window even though his seat belt was fastened, he told his mother.

She said her son lost consciousness, then awakened on the grass to see the car in flames. He tried to help his friend before blacking out again, she said he told her.

"He is taking this very hard. He is in shock," Ben-Amor said of her son. "He's going to survive. His leg is going to mend, but he is heartbroken."

Margate Man killed In I-75 South Florida Car Accident After Pickup Rolls Over

A Margate man was killed Tuesday afternoon on Interstate 75 after he lost control of his pickup truck during a rain storm, according to the Florida Highway Patrol.

Carl Keese, 61, was driving a Ford F-350 with a travel trailer hitched to it and was headed east on the highway near Indian Trace in Weston when he struck a guardrail. The trailer jackknifed and the truck rolled over, troopers said.

Rescue workers said Keese died at the scene.

Troopers said Keese struck the guardrail after he veered to the left in an attempt to avoid slower traffic.

Survery Finds More drivers Using Car Seat Belts In Florida

MostFlorida motorists are buckling up, but more than 12 percent of them still don't use seat belts, state transportation officials announced Tuesday.

The worst offenders are males, pickup truck drivers, Central Floridians and travelers on local roads, a survey found. The best belter-uppers are females and folks over age 60 who use South Florida highways.

State transportation officials commissioned the survey to measure the effectiveness of the "Click It or Ticket" campaign that ran May 24 to June 6.

The surveys are done annually to record seat belt compliance and to help fashion the next safety message to drivers who need to hear it, said Colleen Steinman, a transportation department spokeswoman.

Survey takers observed 151 sites in the 12 most populous counties, where they saw 30,837 drivers and 6,436 front-seat passengers.

The state reports that surveyors found seat belt use increased 2.2 percent after the safety belt campaign. In June, 87.4 percent of drivers buckled up when they got behind the wheel.

Broward Sheriff's Deputy Not Injured After South Florida Car Accident On I-95 In Boca Raton

An accident early Wednesday on Interstate 95 involved a Broward sheriff's deputy, according to Sun Sentinel news partner WPTV-Ch. 5

The accident happened about 1:30 a.m. in the northbound lanes approaching Congress Avenue, the station reported.

According to WPTV, the deputy was in an unmarked vehicle and did not sustain serious injuries.

The Florida Highway Patrol told the station the accident was a rollover crash involving two cars, and that one of the victims was taken to Delray Medical Center as a trauma alert.

All lanes through the accident scene have reopened, according to WPTV.

FHP Cautions Commuters About Florida Car Accidents On I-95 In Jupiter

Motorists are cautioned to watch for a pair of accidents on Interstate 95 in Jupiter.

According to the Florida Highway Patrol, one accident happened on northbound I-95 near the State Road 706 exit, while another is in the southbound lanes near Indiantown Road. No roadblocks are currently reported at either accident.

Rainy weather during the morning commute in southern Martin, northern Palm Beach counties may have contributed to the accidents, according to WPTV NewsChannel 5.

One Dead And Three Injured In Florida Car Accident In Bay County

An 81-year-old woman is dead after a traffic crash Monday afternoon on State Road 77 and County Road 388.

According to the Florida Highway Patrol press release, a 17-year-old Fountain teen was driving on State Road 77 when they failed to yield to the red light at the intersection of County Road 388.

A 2010 Chevrolet Cobalt driven by 86-year-old Charley Carter was given a green light and proceeded forward when it was hit on the left side by the teenager 2004 Mitsubishi SUV.

A rear passenger in the Cobalt, Dovie R. Hartzog of Panama City, was pronounced dead after being transported to an area hospial.

The other passengers in the vehicle were taken to Gulf Coast Medical Center.

Panama City resident, 76-year-old Patricia E. McNight was in critical condition, 86-year-old Cullen C. Hartzog of Panama City was in serious condition and Carter, of Lynn Haven, was in serious condition.

The 17-year-old driver did not receive any injuries. Their passenger, a 16-year-old Fountain teen, suffered minor injuries.

The teen's SUV and the Cobalt sustained around $12,000 in damages each, the release said.

FHP Investigating Two Florida Car Accidents Involving School Buses

The Florida Highway Patrol is reporting two crashes involving school buses in Orlando this morning.

Eight people suffered minor injuries this morning after a school bus rear-ended a Lynx bus on John Young Parkway in Orlando.

The Lynx bus was stopping near Hunters Creek Boulevard when the school bus hit it just before 8 a.m., according to Sgt. Kim Montes of the Florida Highway Patrol.

The school bus driver and seven passengers have been transported to Osceola Regional Medical Center with minor injuries

The school bus driver is facing charges in the crash, Montes said.

In a second crash, a car ran into the back of a school bus transporting students near Rio Grande Avenue and 43rd Street.

No students were injured in the crash.

Federal Government Says Florida's Car Child Safety Seat Law Too Weak

Florida's law requiring child car restraints only up through age 3 is the most lenient in the country, the National Transportation Safety Board said Monday.

And that means thousands of children between the ages of 4 and 8 riding on the state's roads are needlessly at risk, according to the Washington-based agency.

In a statement released Monday, the NTSB cited Florida as one of 21 states, plus two territories, not meeting the agency's 1996 recommendation that restraints be required up to the age of 8 .

It called on the 23 legislatures to pass laws by next year that meet the NTSB guidelines, as eight states did in 2009.

"This action is critical if we are serious about keeping our youngest travelers safe on the roadways," NTSB Chairwoman Deborah A.P. Hersman said in the statement.

In Palm Beach County, several children have been killed in recent years after they bounced around in cars, or were thrown from them, when they were traveling without car seats or were not properly secured in them.

In March, a Boynton Beach man was charged with vehicular homicide in a 2009 crash in which his sport utility vehicle rolled on southbound Interstate 95 in Boca Raton and his 3-year-old son, who by law should have been in a child seat, was thrown from the vehicle, authorities said.

According to the NTSB, Florida, Arizona, and South Dakota are the only three states with no booster seat provision for children older than 4 .

But for nearly a decade, attempts to expand the Sunshine State's law to add booster seats for kids from 4 to 8 have failed.

A Florida House bill this year, which sought to add booster seats for kids from 4 to 7, with exceptions for height, died in committee.

A separate bill was passed by the Senate 33-2 but a companion House bill also died in committee.

A 2009 attempt also failed.

"We support the legislation, and have been quite disappointed that it has never passed," Kelly Powell, program director of Safe Kids Palm Beach County, said Monday.

A bill did pass in 2001, but then-Gov.Bush vetoed it.

"Florida would have been one of the first in the nation to pass a booster seat law," said state Rep. Richard L. Steinberg, D- Miami Beach, a member of the House Roads, Bridges and Ports Policy Committee and co-sponsor of this year's bill.

He said Bush worried that millions of out-of-state tourists wouldn't be in compliance when they drove across the state line into Florida, and said the governor also stood on the principle of parental responsibility.

But, "we have this abyss, of children we know are not properly or safely secured," Steinberg said. "That's absurd."

Rep. Gary Aubuchon, R- Cape Coral, who headed the House roads panel this year but did not support the bill, said it was one of many related to driving that came through his committee - including one banning texting while driving, which did pass.

He agreed with Bush that laws aren't always the answer.

"In the broader picture, people are beginning to resist government intrusion in their lives and their vehicles," Aubuchon said.

Added Ann Howard, spokeswoman for the Florida Department of Highway Safety and Motor Vehicles:

"You don't have to wait for laws to be implemented to protect yourself and your family. We recommend folks keep their children in car seats or booster seats until the age of 7, at least," she said.

"If your child is short, keep them in the seat longer."

Woman Dies In Parasail Florida Accident

A Georgia woman has died days after a parasail's tether detached from a boat during a Florida vacation.

Alejandra White and Shaun Ladd were injured Sept. 5 when the tether between a towboat and passenger harness broke, sending Ladd into the water and White crashing into the beach on a runaway parachute. White was dragged behind the chute through beach umbrellas and into a post on a volleyball court.

A spokesman from the Florida Fish and Wildlife Conservation Commission said the 27-year-old died Saturday.

Her fiance, Ladd, was not seriously injured. The two were from the Atlanta area.

The Coast Guard, Clearwater police and other agencies are investigating.

Man Killed In Florida Car Accident After Pickup Struck Light Pole

A Jacksonville man died Sunday evening after the pickup truck he was driving struck a pole on Amelia Concourse in Nassau County, according to the Florida Highway Patrol.

James R. Strickland, 55, was westbound about 6:45 p.m. when the truck he was driving traveled off the road and struck a light pole about 2.5 miles south of Florida A1A, the Highway Patrol said.

Strickland died at the scene. Authorities do not know why the truck left the road.

He was not wearing a seat belt, the report said.

Jacksonville Woman Dies In Sunday Morning Florida Car Accident

A 25-year-old Jacksonville woman was killed early Sunday on Interstate 295 just north of Commonwealth Avenue.

The Florida Highway Patrol identified the victim as Guadalupe Moreno Santos, saying she wasn't wearing a seat belt in the 9 a.m. accident.

The Highway Patrol said Santos was driving a 2006 Ford F150 pickup truck south on I-295 at a high rate of speed when it veered off the road while apparently trying to avoid another vehicle, and hit a tree head-on. The woman was dead at the scene, according to fire officials.

Florida Jury Awards Teen Infected With E. Coli From Hamburger $653K

On Aug. 15, 2007, the mother of plaintiff Samantha Safranek, a 15-year-old high school student, bought a box of Topps hamburger patties from a Wal-Mart store located at 151 SW 184th Ave., in Pembroke Pines. Two days later, Samantha cooked one of the burgers and ate it. Shortly after, she began suffering from intense pain, cramping, diarrhea, fatigue and dehydration. Doctors discovered she was infected with E. coli 0157:H7, which was traced to the Topps hamburger.

Wal-Mart pulled the patties from the shelves on Aug. 30, 2007, after a single customer complaint. The United States Department of Agriculture conducted tests on the remaining hamburger meat in the box and found the same strand of E. coli that had infected Samantha. A month later, the USDA announced that Topps would be recalling frozen ground beef due to contamination. Shortly after the recall, Topps Meat filed for bankruptcy and went out of business.

David Safranek and Anna Safranek, acting individually and on behalf of their daughter, sued Wal-Mart Stores Inc. and Topps Meat Company LLC for products liability. The plaintiffs brought claims of strict liability, negligence and breach of warranties against the defendants.

Wal-Mart and Topps Meat admitted liability pre-trial. Thus, the matter proceeded to trial on the issue of damages only.

Samantha was taken to the emergency room at the Cleveland Clinic and was admitted to Joe DiMaggio Children's Hospital in Hollywood for two lengthy admissions. She was determined to be infected with E. coli 0157:H7. Samantha suffered acute renal failure, and was diagnosed with hemorrhagic colitis and hemolytic uremic syndrome. Samantha required emergency medical treatment, followed by three weeks of hospitalization. She underwent six days of peritoneal dialysis for acute kidney failure caused by E. coli contamination.

Samantha alleged that she sustained permanent kidney damage and will have to be monitored for the rest of her life.

The plaintiffs sought an award of $7.25 million in damages, including damages for parental consortium.

Defense counsel suggested an award of $600,000 during closing arguments.

The jury rendered a verdict in favor of the plaintiffs, awarding damages in the amount of $748,460.

A directed verdict was entered in the defendants' favor on the filial consortium claims and the court reduced the award for medical expenses based on a medical lien. Thus, a final judgment was entered in the amount of $653,843.

Police Report In-Line Skater Killed In South Florida Car Accident Involving A Hit And Run

A family is mourning the loss of a father and husband after he was killed by a hit-and-run driver.

Karl Arvidsson, 39, was in-line skating to work early Monday morning when he was killed.

"He was a loving father, a loving husband and son," said his wife, Holly Arvidsson.

Holly Arvidsson found several of her husband's belongings crushed at the scene.

The couple had given up their car after Karl Arvidsson was unemployed for several months. He had just begun his new job in construction.

With no car, Arvidsson began his commute at 3 a.m. He skated to a bus stop, then took public transportation. He was a block away from the bus stop on 169th Street and Old Cutler Road when he was killed.

Police said 23-year old Nicole Mitsease hit Arvidsson with her car and then drove off. A good Samaritan found him and called 911.

"He was barely moving," said Adam Dunn, the good Samaritan.

Arvidsson was flown to Jackson Memorial Hospital, where he died.

Mitseas returned to the scene 45 minutes later in a different car. She was with her mother.

"Being scared is no excuse to leave the scene. She should have stayed," said Arvidsson.

Mitseas' father told Local 10's Jonathan Vigliotti that his daughter was returning to a dinner party but did not drink. Mitseas was not tested for alcohol and police allowed her to go home.

It is not the first traffic offense for Mitseas. She's been pulled over for dangerous driving and for driving the wrong way on the highway.

According to state law, leaving the scene of a fatal accident is a first-degree felony punishable by up to 30 years in prison.

Miami-Dade police continue to investigate the case. Although no arrest has been made, police said one could be made in the future.

Mitseas still has her license but her father said he is not allowing her to drive her car.

Karl Arvidsson left behind his wife and a young son.

Police Say Fort Pierce Man Killed In Florida Motorcycle Accident Wasn't Wearing Helmet

Sheriff's investigators have identified a 48-year-old Fort Pierce man who was killed Saturday night when his motorcycle crashed on the overpass bridge between Indian River and St. Lucie counties.

Deputies report Steve Wilson Scott Jr., of 3965 Oak Hammock Lane, died after being taken by ambulance to Lawnwood Regional Medical Center & Heart Institute. He had been driving southbound over the bridge shortly after 8 p.m. when his motorcycle struck a guardrail.

There was no passenger on the bike and no other vehicles appeared to be involved in the crash, said Mike Snowhill, traffic homicide investigator with the Indian River County Sheriff's Office.

Sheriff's Deputy Jeff Luther said Scott was not wearing a helmet when his motorcycle crashed. A helmet and protective leather jacket both were stowed onboard the motorcycle, Luther said.

A witness told deputies that a motorcycle was traveling alongside his vehicle on the Indian River side of the overpass when it quickly accelerated to high speed — perhaps reaching 100 mph, Luther said. The witness told deputies he saw the same motorcycle seconds later, crashed in the roadway.

Deputies reported that Scott was riding a Suzuki Hayabusa. The high-performance motorcycle is described in manufacturer's literature as "the hottest sportbike on the planet

University Considers Rails On Bunks After Death

The University of North Carolina in Chapel Hill may install railings on bunk beds in its dorms after a woman fell to her death in her daughter's room last month.

The News & Observer of Raleigh reported 49-year-old Donna Sykes of Rocky Mount suffered a fatal head injury when she fell Aug. 20. Officials say Sykes was visiting her 19-year-old daughter, Jesse, who had the room to herself.

Officials did not say how high the bed was, but housing director Larry Hicks says the beds in the room were not elevated before the teen moved in it. Students can set the bed up to 77 inches off the floor to create space.

Hicks says he had gotten 68 requests for bed rails before Sykes' death. Officials say they've had about 75 requests since the death.

Miami Heat Dancer Killed In South Florida Car Accident

A Miami Heat dancer on a motorcycle was killed Friday night in a collision with a Mercedes in Fort Lauderdale and police on Saturday were appealing for witnesses to come forward.

Nancy Lopez-Ruiz, 22, of Plantation was riding her 2003 Suzuki GSX R in the westbound right-hand lane of East Sunrise Boulevard when the 9:30 p.m. crash occurred.

Mario Careaga, of Fort Lauderdale, had been driving his 2009 Mercedes behind Lopez-Ruiz. The Mercedes hit the median at the curve of North Federal Highway, then struck the motorcycle, knocking the young woman off her bike. She was pronounced dead on the scene.

Police opened a drunken-driving investigation of Careaga, whose age was not known. Sgt. Frank Sousa, Fort Lauderdale police public information officer, said it would be months before the investigation was concluded.

Lopez-Ruiz had just been hired to dance this season for the Miami Heat.

Eric Woolworth, president of business operations for the Heat, called Lopez-Ruiz "a lovely young woman with an upbeat personality."

"Her fierce passion for dancing was contagious," he added in a statement. "We wish to extend our deepest condolences to her family, friends and teammates."

Patriots QB Brady Unhurt In Car Accident Near Boston Home

New England Patriots quarterback Tom Brady was in a two-car accident near his home Thursday morning but was unhurt and hours later practiced as usual with his team just days before the season opener.

The crash, at an intersection in Boston's Back Bay area, knocked over a light pole and sent a passenger in the other vehicle to the hospital with injuries that were serious but not considered life-threatening, a police report said.

A witness told The Associated Press that the two-time Super Bowl MVP was approaching the intersection on a green light when his black Audi sedan collided with a minivan.

The 21-year-old driver of the Mercury Villager minivan, Ludgero Rodrigues, was cited Thursday for failing to stop at a red light, based on witnesses statements, police said. Two other people in the minivan were able to exit and had no visible injuries, they said.

A telephone listing for Rodrigues could not immediately be found Thursday.

The police report, which did not name Brady, said the driver of the Audi had no visible injuries and was evaluated by Emergency Medical Services. It said a 49-year-old passenger had to be freed with the Jaws of Life and was taken to a hospital.

Brady's father had just arrived in Boston from the family's California home early Thursday and found out about the accident when he got off his flight.

"I understand he's fine, but I haven't talked to him," Tom Brady Sr. told the AP outside his son's home three blocks from the accident site.

Patriots coach Bill Belichick told the team about the accident before practice and said Brady might be a bit late, linebacker Tully Banta-Cain said.

"I was hoping, obviously, that he was OK, but I saw him walking in. He had a smile on his face, no abrasions, so I think he's fine," Banta-Cain said.

The Patriots open their season at home Sunday against the Cincinnati Bengals. Brady remains in talks with the Patriots about a contract extension and is entering the final year of his current contract — a six-year, $57.3 million deal.

During the 11-minute portion of afternoon practice that reporters were allowed to watch Thursday, Brady, in full uniform with pads and helmet, stretched as usual with his teammates. Then, as he usually does, he threw soft passes of 20 to 30 yards to teammates.

"I want to thank the safety personnel for their service, and express our concern and support for the well-being of the occupants of the other vehicle," Brady's agent, Don Yee, said in a statement.

Police responded to Commonwealth Avenue and Gloucester Street around 6:30 a.m. after reports of an accident, police spokeswoman Elaine Driscoll said.

One of Brady's neighbors, a 74-year-old woman who asked that her name not be used for fear of being hounded by reporters, was walking her dogs when she saw the accident.

She said Brady was traveling south on Gloucester and approaching the intersection on a green light when his black Audi collided with a fast-moving red Ford Aerostar that was westbound on Commonwealth.

"The red car went up in the air, sideways. ... The tire was half off," the woman said.

Afterward, she said Brady immediately got out of his car.

The woman had been walking toward the intersection when she saw the cars on their collision course. She took a step backward, tripped on the curb and hit her head, she said.

She sat next to Brady in an ambulance, but neither was taken to a hospital. She said she did not realize he was the star quarterback until later.

Bill Barron said he was in his apartment overlooking the intersection when he heard a collision that sounded like "a bolt of lightning."

When he looked out the window, he saw the driver of the car picking glass off his clothes and wiping himself off with a towel. He didn't realize until later that it was Brady.

"I thought it was some college kid who had crashed up his father's really nice car," Barron said.

Brady then retrieved some items from his car, made a series of phone calls and was picked up by another vehicle, Barron said.

Crawfordville Man Killed In Florida Car Accident

A 23-year-old Crawfordville man died in an alcohol-related one vehicle traffic accident on Smith Creek Highway (Highway 375) at approximately 1 a.m. Friday, Sept. 10, according to Sheriff David Harvey.

Marcus Brandon Kelley was ejected from the vehicle and pronounced dead at the scene in rural Wakulla County after a traffic roll-over accident. The driver of the vehicle, Jessica Marie Bouchard Kelley, 22, of Crawfordville, was not seriously injured.

The Wakulla County Sheriff's Office Traffic Unit worked the accident scene and determined that the couple was southbound on Highway 375 four miles south of the Leon County line when the 2001 Chevrolet pickup truck left the roadway and struck a guardrail south of Piney Creek Road. The vehicle flipped and ejected Marcus Kelley who was not wearing a seatbelt. His wife was wearing a seatbelt at the time of the crash.

The victim was pronounced dead at the scene at 1:28 a.m. Jessica Kelley was taken into protective custody following the accident. Charges are pending the outcome of the investigation.

The Kelley death is the second fatality on Wakulla County roads in 2010 and the first traffic homicide worked by the WCSO Traffic Unit. Investigating the accident are Deputies Dale Evans and Ben Steinle of the Traffic Unit. Lt. C.L. Morrison and Deputies Ward Kromer and Rachel Oliver of the road patrol assisted at the accident scene

Father Arrested After Allegedly Running Over Son In Florida Car Accident

A central Florida father has been charged with child neglect after he allegedly ran over his son's leg with a truck and didn't report it.
Osceola County Sheriff's deputies said Jason Carter was dropping
his 5-year-old son off at the school bus stop Thursday when the boy
jumped out before he came to a complete stop. Carter said his son
was lying on the ground, but wasn't crying and didn't appear to be
injured so he placed him on the bus. He said he called the school
to alert them his son might have hurt his knee and to call him if
the injury got worse.

The boy told the school nurse he fell out of his dad's truck and
was run over. A doctor found tire tread marks on the boy's thigh.
Carter told authorities he had been drinking beer before driving
his son to school.

Child Airlifted To Hospital After Being Struck In Florida Car Accident In DeLand

A toddler has been airlifted to a hospital after the child was struck by vehicle this morning in DeLand.

The 2-year-old child's mother went to a store across the street while the child was sleeping, police said. The child woke up and then tried to follow the mother across the street and was clipped by the mirror of a passing car, said DeLand police Sgt. John Anderson.

The incident happened just after 7 a.m. near New York Avenue and Boston Avenue.

Pedestrian Airlifted To Hospital After Being Hit By Pickup Truck In South Florida Car Accident

A woman was airlifted to a hospital Friday morning after she was hit by a pickup truck in northwestern Miami-Dade County.

The crash occurred near Northeast 167th Street and Fourth Avenue sometime after 8 a.m.

Miami-Dade police said the woman was crossing Northeast 167th Street when a Ford pickup truck hit her.

The woman was airlifted to Jackson Memorial Hospital's Ryder Trauma Center. Police have not released information on her condition.

Police said the driver of the truck stayed.

Man Injured In Hit And Run South Florida Accident Involving Motorcycle

Police are searching for a motorcyclist involved in a hit-and-run crash that left a pedestrian with broken bones and other serious injuries.

Mack Hickson, 66, is being treated at Delray Medical Center and is expected to survive.

The collision happened shortly before 1 a.m. Wednesday when a motorcycle struck Hickson as he walked across West Atlantic Avenue, according to a witness

Hickson victim stepped off the curb in front of the motorcycle and landed in the middle of the intersection at Northwest 10th Avenue, according to Officer Jeffrey Messer.

The make and model of the motorcycle is unknown, but debris found at the scene leads police to believe the bike sustained headlight and possible front windshield damage.

Florida Lawsuit Challenges West Palm Beach And State For Red Light Cameras

A new state law that allows municipalities to use cameras as cops to catch motorists running red lights violates one of the basic tenets of the nation's criminal justice system: Innocent until proven guilty.

That's the claim in the latest legal salvo fired against both the state and the city of West Palm Beach in an effort to invalidate the program that has become a bane for motorists and a cash bonanza for cities.

Forcing those caught on camera to prove they weren't at the wheel turns the constitution on its head, said attorney William Abramson. He filed the suit last week on behalf of a client who received a citation on July 15 for allegedly running a red light at Australian Avenue and 25th Street.

"We are a society that's based on innocent till proven guilty," he said. "Now, under this, it's guilty until proven innocent."

According to the law that went into effect July 1, a motorist can either pay a $158 fine or submit proof that he wasn't driving. Instead, Abramson said, the city should have to prove that the owner of the vehicle was at the wheel.

According to the law, tickets are sent to the registered owner of the vehicle. If more than one name appears on the registration, it is sent to the first name listed. If the owner claims someone else was driving, that person can be cited.

"The presumption of guilt, shifting of the burden of proof, and arbitrary and capricious nature of this statute" violates both the state and U.S. constitutions, he wrote.

Attorney Jason Weisser, who has filed 26 lawsuits throughout the state aimed at invalidating the use of red light cameras, said he has raised similar issues. Most of his lawsuits are aimed at programs, such as those in West Palm Beach and Juno Beach, that went into effect before the state law was passed in the spring.

Abramson's lawsuit is aimed at invalidating the new law.

A spokeswoman for attorney General Bill McCollum declined to comment on the lawsuit. When the measure was proposed, a legislative staff analysis found it raised no constitutional problems

Several People In Hospital After South Florida Car Accident On I-95 in Hollywood

A two-vehicle crash on Interstate 95 in Hollyowood sent several adults and children to area hospitals Thursday, the Florida Highway Patrol said.

One injured person was in critical condition, said FHP Sgt. Mark Wysocky. The conditions of the other people wasn't immediately available, he said.

The collision occurred in the northbound lanes of I-95 near the Sheridan Street exit at about 11 a.m., Wysocky said. One vehicle stopped in the middle of the roadway because of a flat tire and another vehicle rear-ended it, he said.

Rear End Florida Car Accident Involving School Bus In Kissimmee Injures Driver

A rear-end collision in Kissimmee this morning sparked a chain reaction that pushed another car into the back of a school bus.

Florida Highway Patrol reports show Derek Pereira was driving his Ford truck on KOA Street sometime around 7:54 a.m. when he struck the back of Jorge Fernandez's stopped car at Marigold Avenue.

The impact sent that car into the back of a school bus that was waiting at the light.

Troopers said Fernandez suffered minor injuries. None of the others was injured in the accident.

Pereira faces charges of careless driving and no proof of registration.

South Florida Car Accident Involving Tractor-Trailer And Motorcycles Closes Road

Krome Avenue was closed in both directions Thursday after a crash involving a tractor-trailer and three motorcycles.

The crash occurred just after 11 a.m. on Krome Avenue about five miles north of Southwest Eighth Street.

From Sky 10 overhead, it appeared that the tractor-trailer had jackknifed. It is unclear what led to the crash.

Police said two people were injured in the crash. Both were airlifted to Jackson Memorial Hospital.

The Florida Highway Patrol and Miami-Dade Fire Rescue are investigating.

State Pays $4.4 Million To College Student Injured On Field Trip

On May 24, 2001, plaintiff Adam Oleksy, 20, a student of Buffalo State College, was on a paleontological dig in Oberlin, Kan. The expedition was sponsored by the university and overseen by two of its professors, William Korth and Steven Vermette. While Oleksy was digging out a fossil in a large rock formation, the formation collapsed, burying Oleksy up to his neck in rock. Oleksy claimed that he sustained injuries of his spine, pelvis and abdomen.

Oleksy sued Korth and Vermette. Oleksy alleged that the professors were negligent in their oversight of the expedition.

Plaintiff's counsel presented a geological expert, who opined that the rock formation was visibly compromised. One of the students who participated in the expedition testified that there were obvious cracks in the rock face and that large fallen rocks were observed around the area of the incident.

Oleksy was taken to an emergency facility 30 minutes away from the accident scene, from which he was flown to Christi Medical Center in Wichita, Kan.

Oleksy suffered a fracture dislocation at L4. The collapsing rock also ruptured Oleksy's diaphragm, which resulted in his organs being displaced from his stomach into his chest cavity. He also sustained multiple fractures of his pelvis and iliac bones.

Oleksy underwent a laminectomy at L1, L2, L3, and L4. He had a plate and four screws inserted to secure his pubic symphysis. Pins were also used to fixate the fracture of his sacroiliac joint on the left and right side. Oleksy also underwent a laparotomy to access his abdomen and reposition his displaced organs.

Oleksy underwent six months of physical therapy and later received at home therapy. He is still on medications to manage pain. He has a permanent foot drop, requiring the use of a brace for the rest of his life.

Oleksy's expert orthopedist opined that he would require continued pain medication and that he also diagnosed post-traumatic arthritis. The arthritis will continue to worsen and further debilitate Oleksy, the expert contended.

Oleksy contended that he cannot stand or sit for long periods of time. He finished college with a degree in teaching, but after assuming a teaching position, he discovered he was not able to fulfill the position because of the long periods of standing and leaning over student's desks. Oleksy ultimately took a position as a computer programmer which was outside his field. The need for future surgery is unclear, but Oleksy assumed he will need pain medication and medical care for the rest of his life.

Oleksy was also very active prior to the accident; he regularly exercised and lifted weights. He was also captain of his school's lacrosse team. Following the accident; he was precluded from any of his prior physical activities.

Oleksy sought recovery of damages for his past and future pain and suffering.

Defense did not contend any of the injuries.

The parties negotiated a pretrial settlement. The defendants' employer, the state of New York, agreed to pay $4.4 million.

Car Accident Deaths Fall To Lowest Level Since 1950

The number of people dying on the nation's roads has fallen to its lowest level in six decades, helped by a combination of seat belts, safer cars and tougher enforcement of drunken driving laws.

The Transportation Department said late Wednesday that traffic deaths fell 9.7 percent in 2009 to 33,808, the lowest number since 1950. In 2008, an estimated 37,423 people died on the highways.

Transportation Secretary Ray LaHood said the annual report "shows that America's roads are the safest they've ever been. But they must be safer. And we will not rest until they are."

Forty-one states, the District of Columbia and Puerto Rico saw reductions in highway fatalities, led by Florida with 422 fewer deaths and Texas, down 405.

The rate of deaths per 100 million miles traveled also dropped to a record low. It fell to 1.13 deaths per 100 million miles in 2009, compared with 1.26 the year before.

Year-to-year declines in highway deaths have occurred in previous economic downturns, when fewer people are out on the road. Traffic deaths decreased in the early 1980s and early 1990s when difficult economic conditions led many drivers to cut back on discretionary travel.

But last year's reduction in fatalities came even as the estimated number of miles traveled by motorists in 2009 increased 0.2 percent over 2008 levels.

Eight Year Old Struck And Killed By Delivery Truck In South Florida Accident In Greenacres

An 8-year-old boy was struck and killed by a delivery truck on Wednesday as he walked home from school with his father.

Both the boy and his father were heading south on a sidewalk on Jog Road near 13th Road South, when the child was struck, said Public Safety Department Capt. Michael Porath.

Porath was not immediately able to identify the boy or say what school he attended.

Kevin Gonzalez of Greenacres saw the boy lying on the sidewalk and called 911.

"It is such a tragedy," Gonzalez said.

The boy's father was taken away from the scene by police.

New York Man Killed In Florida Car Accident In St. Augustine

A 22-year-old New York man was killed Tuesday night as he was walking down U.S. 1 near Lewis Speedway in St. Augustine.

Dominic Amodeo, of Huntington Station, was walking south on the roadway shoulder at 9:15 p.m. when a 2005 Ford Five Hundred driven by Nicole C. Jonas, 21, of Palm Coast, left the lane and hit him, according to the Florida Highway Patrol. Amodeo was dead at the scene, according to the Highway Patrol.

Jury Awards $6.2 Million To Family Of Man Killed In Florida Accident During CT Scan

In December 2002, plaintiff Cory Fine, a 41 year old college professor, entered Shands Hospital in Gainesville to undergo gastric bypass surgery. The surgery was uneventful, but five days later, Fine developed breathing difficulties. As a result, he was sent to undergo a CT scan of his lungs. While in the machine, Fine died. An autopsy was performed, but it did not rule an official cause of death.

Linda Fine, acting as the personal representative of her husband's estate, sued the hospital's operator, Shands Teaching Hospital and Clinics Inc., for wrongful death and medical malpractice.

Plaintiff's counsel contended that the cause of death was a cardiac arrhythmia. He contended that Fine was already suffering from low levels of oxygen and was in respiratory distress prior to the scan. He argued that as a result, a nurse should have been dispatched to monitor Fine's condition, as well as accompanied the patient to the CT scan. Plaintiff's counsel also contended that an oxygen saturation test would have taken a mere few moments, but that nobody ever checked Fine's oxygen saturation levels or heart rate prior to the CT scan. He argued that the technicians should have immediately called for help after noticing that Fine was sweating profusely and stating that he felt like he would die. In addition, plaintiff's counsel argued that Fine should not have been placed lying flat because this caused the organs to shift and result in dangerously lowered levels of oxygen, as well as because Fine indicated he had trouble breathing in that position.

Defense counsel argued that the MRI was done according to standard procedure and that Fine gave his oral consent for the procedure to be performed. Defense counsel further contended that the cause of death was a rare condition due to a reaction to the contrast dye in the MRI machine.

Fine died in the CT scan machine in December 2002. He died at the age of 41. He was survived by his wife of 10 years and his son who was three at the time.

Prior to his death, Fine was a professor at the University of North Florida, teaching industrial relations, earning in excess of $100,000 a year. The estate claimed that Fine's son never really grew up to know his father, and his memories of his father are mainly from video and through photographs.

Thus, the estate sought recovery of damages for Fine's wrongful death, as well as for his son's loss of parental guidance and the family's loss of financial support. The estate also sought recovery of funeral expenses.

The jury found Shands negligent in Fine's treatment. It awarded a total of $6.2 million. Of the total award, Fine's wife received $2.5 million in non-economic damages, Fine's wife and child received $2.2 million in economic damages, and Fine's child received $1.5 million in non-economic damages.

No post trialmotions have filed as of thistime.

Coral Springs Woman Dies In I-95 South Florida Car Accident In Boynton Beach

A Coral Springs woman died after she was thrown from an SUV that crashed on Interstate 95 in Boynton Beach last week, authorities said.

Dorida Mocaj, 25, died Friday at Delray Medical Center, according to the Florida Highway Patrol.

Mocaj was riding in a 2004 Ford Explorer on Thursday night when the driver lost control on northbound I-95 near the Woolbright Road exit, FHP said.

The driver, Jeremiah Walker, 35, veered into a grassy median, flipping over the SUV and throwing them both out.

The pair was taken to Delray Medical Center, where Mocaj died the next day. Walker, of Parkland, remains in critical condition.

Possible charges are pending.

Boca Raton Pedestrian Struck And Killed In South Florida Car Accident

A 54-year-old woman was fatally struck by an SUV as she crossed Lyons Road west of Boca Raton Tuesday morning, authorities said.

Roberta Tenenbaum, 54, of Boca Raton, walked in front of a 2005 GMC Yukon as she crossed the road just south of the intersection with Sonoma Lake Boulevard, according to the Palm Beach County Sheriff's Office.

The driver, Emanouel Legakis, 29, was traveling north on Lyons Road and slammed on the brakes during the crash, the Sheriff's Office said. He stopped and was not injured.

Tenenbaum died at the scene around 9 a.m. Possible charges are pending.

Driver In Florida Car Accident Killed When Car Struck Garbage Truck

The driver of a car that crashed into a garbage truck in central Florida has died. The driver was not immediately identified late Monday. The driver of the garbage truck was not injured.

The Florida Highway Patrol is investigating the crash that happened Monday morning off the ramp of I-95 at State Road 524 in the Cocoa area in Brevard County.

When fire rescue crews arrived, the driver of the car was still in the vehicle. The driver was pronounced dead at the scene.

Police Investigating Fatal Florida Car Accident On Tram Road

On Saturday, September 4, 2010 at approximately 3:19 pm, the Leon County Sheriff's Office received reports of a two vehicle traffic crash near the intersection of Tram Road and W. W. Kelley Road. LCSO Uniform Patrol Deputies and the Traffic Homicide Unit responded to the scene and are conducting the investigation.

Initial information indicates that two vehicles collided in the intersection causing multiple injuries and one fatality. Electrical power was interrupted in the area as a result of the crash. Tractor-Trailer Florida Car Accident Causes Minor Injuries But Huge Traffic Problems

The westbound lanes of Interstate 4 near Fairbanks Avenue are open again after several hours following a 100-gallon fuel spill from a jackknifed Walmart truck, the Florida Highway Patrol said.

However, the westbound highway has only the left lane open at State Road 434 in Longwood because of a new crash. A pickup rear-ended a semi, authorities said. Details are still emerging, but one thing is clear: It's best to avoid the area.

The driver of the Walmart truck, William Smith, 60, of Webster was ticketed for going too fast for the rainy conditions, said FHP Sgt. Kim Montes. The driver on a curve about 6:15 p.m. when he lost control.

"When you're in a semi in the rain, the slightest mistake will mess you up," Montes said. Fuel rained down onto Wymore Road from an I-4 overpass, and authorities tried to divert traffic at Lee Road. Wymore Road was closed in both directions until the mess was cleaned up.

Smith was slightly hurt but did not require hospitalization, the FHP said.

The accident happened shortly after a crash in the eastbound lanes at Lee Road that snarled traffic. That crash, shortly before 4 p.m., was cleared by 5:30 p.m.

Authorities shut down the westbound lanes of Interstate 4 near Fairbanks Avenue for several hours Monday night while they worked a wreck involving a tractor-trailer, according to Florida Highway Patrol.

The crash occurred around 6:20 p.m. The semi jack-knifed, causing fuel to spill across the roadway.

The driver suffered minor injuries but was not transported from the scene, FHP said.

Authorities tried to divert traffic at the Lee Road exit.

This incident occurred about more than an hour after the eastbound lanes near Lee Road, which is just east of Fairbanks, were cleared following a crash.

The wreck occurred shortly after 4 p.m. at mile marker 88. Authorities had the roadway clear before 5:30 p.m. Details about the crash weren't available.

Tamarac Man Dies In South Florida Car Accident When Car Hits Tree

An 18-year-old Tamarac man was killed when his car hit a tree Monday afternoon, police said.

Dominick Greco was pronounced dead at the scene of the 3:50 p.m. accident, according to police.

Greco's passenger, Chastity Lumpkin, 17, also of Tamarac, was taken to North Broward Medical Center in serious condition, according to the police news release.

Greco was driving a 1999 Honda Accord south on Coral Springs Drive when he hit the tree at high speed on the west side of the shoulder about 50 yards north of Royal Palm Boulevard, the release said.

Motorcyclist Dies After Being Run Over By SUV In South Florida Car Accident

A motorcyclist was killed when an SUV hit then ran over the man in a parking lot west of West Palm Beach, the Palm Beach County Sheriff's Office said Sunday.

Ginika Sawyer, 32, of Indiantown, was driving down an access road for the Case Loma mobile home park when she turned right into the rear parking lot of the 1489 Plaza building, deputies said.

As Sawyer pulled in, deputies said William E. Germond, 66, of west of West Palm Beach, was driving toward the exit on his 2002 Harley-Davidson.

The two collided and Germond was knocked off his motorcycle, the Sheriff's Office said. Sawyer then ran over Germond with her Isuzu Trooper, stopping a short distance away from the crash, which occurred about 4 p.m. Saturday at 1489 N. Military Trail.

Germond was taken to St. Mary's Medical Center, where he was pronounced dead.

Deputies did not say whether Germond was wearing a helmet.

Three Killed In Florida Car Accident In Tampa

Three people have died after two cars collided at a dangerous Tampa intersection.

Tampa Police spokeswoman Andrea Davis said a Buick with a 67-year-old male driver, his 46-year-old wife and a 58-year-old friend crashed Thursday night with a Dodge. Three people in the Dodge were taken to the hospital with non-life-threatening injuries.

More than 100 onlookers gathered at the scene. Some complained about the dangers of the intersection, saying views of oncoming traffic are obstructed by a building, forcing drivers to pull out beyond the traffic signs to see if anyone is coming.

Authorities are still investigating the cause of the crash.

Jacksonville Woman Killed After Florida Car Accident, Her Children Survive

A Jacksonville woman traveling with two young children was killed Thursday evening after she lost control of her car on Florida 9A near Alta Drive, the Florida Highway Patrol said.

Farren M. Carter, 24, was northbound in the inside lane about 7:35 p.m. when she lost control for an unknown reason, the report said. Carter tried to swerve back onto the road from the median but failed to regain control of the Honda Accord. The car began to rotate clockwise as it traveled across both northbound lanes, eventually going down the embankment and flipping over before coming to rest on its roof.

Carter was taken to Shands Jacksonville hospital but died, the Highway Patrol said.

The two children with Carter, 6-year-old Jody Price and 4-year-old Jaden Thomas, were also taken to Shands Jacksonville hospital. They did not suffer serious injuries.

The children were wearing their seat belts while Carter did not have hers on, the FHP said.

Tour Bus Kills Woman In South Florida Car Accident

A woman died after a tour bus hit her while she attempted to cross the street in South Beach Friday morning.

Police blocked off Collins Avenue traffic from Ninth to 11th Street.

The unidentified woman's body was covered with yellow plastic at the 10th Street intersection.

On the ground, near the black barricades police used to block pedestrians from viewing the body, there was a green grocery shopping bag and a straw hat. The woman appeared to be in her 60s, according to an officer at the scene.

The private tour bus hit the woman about 9:15 a.m. She died at the scene.

South Florida Drivers Will See More Green Lights

Drivers on Broward Boulevard might have already noticedall of the green traffic lights.

For the first time in years, drivers commuting into or out of downtown Fort Lauderdale on Broward Boulevard can actually make it a mile, or two, or three, or four, or more, without hitting a single red light.

The same is true on University Drive in the center of the county, where drivers are hitting more green lights than ever. They're spending less time sitting at the reds.

The outcry from angry drivers finally has been heard. Broward County officials just announced that they've re-timed traffic signals on the eastern part of Broward Boulevard and much of University Drive, so drivers traveling the speed limit will hit green light after green light after green light.

The maddening stop-and-go that drivers endure all over will be eased by early 2011, county officials promise. Signals on 19 major east-west corridors, plus the entire north-south stretches of U.S. 1 and University Drive in Broward County, will be re-timed.

After that, a year's worth of more complicated and expensive synchronization is promised; it would re-time more of the road network, adding north-south roads to finesse what traffic engineers call the "basket weave" of intersecting streets.

"We can't promise all green lights," Broward public works director Thomas Hutka said, "but we're reducing the number of times you stop at red lights.''

Hutka was hired last year and made the synchronizing of lights "absolutely a priority.'' He brought the top traffic engineers into one office — they named themselves the Green Light Strike Force — and they work on re-timing signals every day. A website's been set up, and a phone hotline is ready; both will be used to solicit opinions from the driving public.

Hutka said the Strike Force set out two months ago to make a noticeable improvement to signal snarl using existing staff and hardware, at no additional cost to the county taxpayers. The team re-timed lights on Broward Boulevard from University Drive east to U.S. 1., and on University Drive, from Oakland Park Boulevard to Griffin Road.

With the exception of University Drive and U.S. 1, the team's initial signal timing efforts are focused on east-west roads because north-south commuters have high-speed options via Interstate 95, Florida's Turnpike and the Sawgrass Expressway/Interstate 75.

The next complicated step will be timing signals on north-south roads and coordinating them with east-west routes.

The work is part of a 15-year, $85.6 million overhaul of the signal network.

Timing traffic signals in a progression for drivers is an industry standard and "one of the most cost-effective ways to improve traffic flows and reduce motorist travel time," county auditor Evan Lukic noted in a 2008 investigation.

Drivers pleaded for it. County commissioners promised it.

Yet, the auditor's office found, Broward County failed to deliver it, falling far short of "industry best practice.'' The county devoted insufficient staff to the work and let years pass without revisiting signals on heavily traveled thoroughfares such as Griffin Road.

The result of the county's lackluster work: Drivers in Broward County the past decade spent more time at red lights than they should have, their drive times were longer than they needed to be, and they wasted gas, auditors said.

Before now, it was nearly impossible to travel east or west on Broward Boulevard without hitting half a dozen or more red lights. Now, drivers can make it through more than 20 green lights in a row.

On University Drive, Hutka said he hit a "small traffic jam'' every morning heading south between Sunrise and Broward boulevards.

The system isn't perfect. On any given day, traffic accidents, gridlock, trains, emergency vehicles that preempt the lights, or road construction and lane squeezes will screw up the light synching. But it'll still be an improvement on what drivers are used to.

Another facet of the fix: The county will improve traffic detection on side streets so drivers on the main roads aren't stopped unnecessarily.

"When you're driving on a major street and you see a red light turn in front of you for no apparent reason,'' Hutka said, "or because one or two cars are coming in from the side street, this is what it's all about. This will significantly reduce the number of those occurrences.''

Broward County is in the midst of a $14.5 million project to install video detectors at 700 intersections countywide. When the work is completed in about 3 years, 1,250 intersections in the county will have the new technology.

The detectors look like cameras mounted on traffic signal poles, but they don't take pictures or record video. Instead, they detect how many cars are lined up at intersections. The images are analyzed by computers that determine how much green time a traffic signal should provide.

Let's say a signal is programmed to give 15 seconds of green time for a left turn. If the left turn lane is empty after five seconds, the detector will turn off the left turn arrow and assign the unused 10 seconds of "green time" to drivers going straight through the intersection. That means the green light will last longer for the majority of drivers.

Drivers like Pete Tozzi said traffic signals on "pip squeak" cross streets hold up traffic on major roads.

Heading west on Pines Boulevard at rush hour, Tozzi said Pines drivers routinely get stopped for one or two cars entering Pines from 129th and 136th avenues. But the light stays green even though no more traffic is coming. Signals on Pines are scheduled for re-timing later this year.

"One would think those two streets are the main thoroughfare with their prolonged green lights," he said. "I could personally drive around and improve traffic with a little common thinking and light time changes."

On Southwest 10th Street, drivers complain of constant stop-and-go conditions between Federal Highway and the Sawgrass Expressway because of poorly timed traffic signals.

"At all times of day or night you get stopped at 90 percent of the traffic signals. It is intolerable," said Joseph Healey, who commutes from Coral Springs to Boca Raton.

That busy connector between I-95 and the Sawgrass is scheduled for re-timing later this year.

But rush hour drivers still likely will be held up at some red lights, as traffic engineers balance the need to keep traffic flowing on north-south highways that intersect it, like Military Trail, Powerline Road and even the I-95 exit ramps to prevent traffic from backing up onto the interstate.

"If you hit just one red light, you can be assured that you will hit them all," said Carol Finkelstein, of Boca Raton.

As the county gives new focus to drivers' frustration, Hutka said he's considering all options, including what Miami-Dade County does on some major roads like Biscayne Boulevard: putting signals into flashing mode — flashing red and yellow — between midnight and 5 a.m. to allow traffic on the major street to flow without stopping.

"It's something we want to study more,'' Hutka said. But if the signal re-timing is a success, he said, that might not be necessary.

Plaintiff Alleges South Florida Car Accident With Drunken Driver Was Cause Of Neck Injury

On Feb. 1, 2005, plaintiff Moise Leveille, a 29-year-old barber, was operating a motor vehicle near the intersection of Homewood Boulevard and Lowson Boulevard in Del Ray Beach. As he entered the intersection, he was hit by a vehicle driven by Beverly Storey. Storey, who was intoxicated at the time, slowed at the four-way stop and then rolled through the intersection. She crossed the center line and hit the driver's side front panel Leveille's Navigator. Leveille allegedly sustained neck, back and shoulder injuries as a result of the accident.

Leveille sued Storey for negligent operation of a motor vehicle.

Storey was charged with driving under the influence. Negligence was admitted, but the defendant contested the case on causation and damages.

Leveille did not seek treatment until two days after the accident. He alleged neck, back and left shoulder pain. Leveille underwent chiropractic treatment and physical therapy at Sunshine Holistic Health Center from March through September 2005.

The plaintiff's physical medicine expert opined that Leveille sustained a herniated disc at C3-4 as a result of the accident. The expert assigned a 1 percent permanent impairment rating to both his cervical and lumbar spine. MRIs were taken on Feb. 11, 2005, and again on June 30, 2005. The plaintiff's expert radiologist also testified that Leveille had sustained a herniated disc at C3-4, which was shown on an MRI taken on Feb. 11, 2005. However, by June 30, 2005, no herniation appeared on the MRI, and there was no mention of a herniation in Leveille's records.

Leveille claimed that after the injury he was not able to work eight and nine hours a day, as he had before the crash. He claimed that he was only able to work approximately five hours daily, but he could not produce tax returns to substantiate a claim for lost wages. He asked for $75,000 in damages.

According to defense counsel, the plaintiff's medical records were in shambles and were possibly back dated.

According to the defendant's experts, Leveille did not sustain a permanent injury as a result of the accident. The defendant's radiology expert testified based upon his review of both sets of MRIs. He opined that there was no evidence of a herniated disc in either February 2005 or June 2005.

The jury rendered a defense verdict. It found that the defendant's negligence was not a legal cause of the plaintiff's injuries.

Vehicle Hits Bike In South Florida Car Accident Sends Rider To Hospital

A bicyclist was taken to the hospital this morning after being struck by a vehicle in suburban West Palm Beach before sunrise.

The wreck happened at 5:51 a.m. on Roebuck Road just east of Haverhill Road, according to Palm Beach County Fire-Rescue dispatch records.

The person on the bike was taken to the hospital. Sheriff's investigators were called to the scene, Palm Beach County Sheriff's dispatchers confirm. Traffic was blocked briefly, but the road was open by 6:30 a.m.

AT&T Settles Over Discrimination Claim

In February 2007, claimant Michael Rappe, age not given, applied to be a splicer technician for AT&T Services Inc. in Austin.

On behalf of Rappe, the Equal Employment Opportunity Commission brought a suit against AT&T Services Inc., operating as Southwestern Bell Telephone Co., L..P. The plaintiff claimed that the company violated the Americans With Disabilities Act by not hiring Rappe because of his insulin use for type 2 diabetes. Plaintiff's counsel noted that Rappe had performed a similar job for AT&T for many years after his diagnosis.

The defendant denied the claims, noting Rappe did not fall within the ADA guidelines.

The plaintiff asked for an award that included past and future pecuniary losses, relocation, job search, medical expenses and punitive damages.

Both sides reached a consent decree resolving the suit. The defendant paid $60,000 to Rappe. The company also agreed to comply with the provisions of the ADA. This will include providing training regarding the ADA to all staffing managers at AT&T's non-management staffing office located in San Antonio. The phone company further agreed to have these staffing managers review AT&T's equal employment opportunity policies which prohibits discrimination on the basis of disability and to acknowledge, in writing, that insulin treatment for diabetes, in and of itself, does not automatically disqualify an individual from employment.

Court Documents Say Disney Created Situation That Led To Florida Accident

In new court documents, the mother of a Disney monorail worker killed last year accuses her son's former boss of "flippantly" vacating his duty, creating a dangerous situation that "was virtually certain to result in injury or death."

21-year-old Disney monorail pilot Austin Wuennenberg was killed on July 5, 2009 when two monorails collided. His mother, Christine Wuennenberg, filed suit against Walt Disney Parks and Resorts in January.

In court documents, Christine Wuennenberg accuses the monorail operations manager, David Gilmore, of creating a dangerous situation by taking an on-duty meal break with other employees, leaving the monorail control tower unstaffed.

In the documents, Wuennenberg says Gilmore didn't tell her son or other pilots that no one was going to be monitoring the monorails directly.

If someone had been, Wuennenberg says, they could have used video monitors to see that a collision was coming.

"Anyone paying even casual attention" would have been able to "see it, hear it and feel it," she said, and ultimately, to stop it.

"There was a line de-energizing button in the Concourse Tower that would have enabled anyone in the Tower to simply push a button to stop this terrible collision from occurring," Wuennenberg said in the documents.

The crash occurred about 2 a.m. near the end of a workday. A monorail train was backing along a track switch that was supposed to re-align but didn't, switching the monorail from the resort's Epcot line to a short spur leading to a Magic Kingdom line.

The switch never re-aligned, so the train wound up driving in reverse, smashing into a second train piloted by Austin Wuennenberg.

Disney has since admitted that the monorail pilot was told to go in reverse and that, before the collision, there was an incorrect report that the track switch had been aligned properly.

Disney spokeswoman Zoraya Suarez would not comment on the specific allegations made by the monorail pilot's mother, calling the depositions containing Wuennenberg's accusations "a part of the normal process."

"We will respond when appropriate through the court," Suarez said.

Two Killed In Florida Car Accident In South Osceola County

A woman and her 2-year-old child were killed Wednesday night when the trailer portion of a tractor-trailer crushed their pickup in rural south Osceola County, the Florida Highway Patrol said.

The accident happened at the exit ramp to Florida's Turnpike in Yeehaw Junction, said Sgt. Kim Montes, a highway patrol spokeswoman.

Cassandra Green, 33, of Orlando, and her son, 2-year-old Steven Holtzapple Jr., died at the scene, according to the highway patrol.

The tractor-trailer loaded with pineapples, which was westbound on State Road 60, was going too fast as it tried to enter the turnpike, Montes said. The pickup driver was coming off the turnpike and waiting to turn onto S.R. 60.

The trailer crushed the 2004 Chevrolet, Montes said. The cab portion also fell over, but 68-year-old Boca Raton resident Reynaldo Santos, the tractor trailer's driver, received only minor injuries and wasn't taken to a hospital, she said.

It took about 45 minutes for a trooper to reach the remote location near the border of Okeechobee County and hours longer to untangle the wreckage.

Woman Rescued After South Florida Car Accident When Car Sinks In Delray Beach Lake

Two police officers and several good Samaritans may have saved the life of a 73-year-old BoyntonBeach woman Wednesday morning after her car crashed, spun out of control and began sinking in a manmade retention pond.

The officers and civilians pulled the woman from her car as it slowly sank into the pond just east of Lake Ida Road and Congress Avenue.

The woman, whose identity police have not released, was driving west on Lake Ida at 10:34 a.m. Police at the scene said a truck pulled out of Delray Park of Commerce and hit her 2010 Audi convertible, sending it spinning out of control, over a sidewalk, down an embankment and into the a manmade retention pond.

Delray Beach police received several 911 calls, and Officer Stephanie Kearney and Detective Michael Debree, along with several good Samaritans, jumped into the water to try to free her.

The woman's leg was trapped in her car, but she was freed within minutes, just before the car became submerged, police said.

"It seems obvious that without the help of the rescuing officers and good Samaritans, the trapped driver would have been subject to serious if not fatal injuries," Officer Jeffrey Messer, police spokesman, said in a news release.

The woman was evaluated at Bethesda Memorial Hospital, found to be uninjured and was released.

St. Augustine Motorcyclist Suffers Life-Threatening Injuries After Florida Accident With Deer

A St. Augustine man suffered life-threatening injuries after he hit a deer on his motorcycle Tuesday night in St. Johns County, the Florida Highway Patrol said.

Philip M. Cooley, 49, was eastbound on Florida 206 near East Seacove Avenue in St. Johns County about 10:40 p.m. when a deer entered the path of his Honda motorcycle, the Highway Patrol said. The front of the motorcycle struck the deer.

Cooley, who was wearing a helmet, was taken to Shands Jacksonville hospital for life-threatening injuries, according to the report.

Memorial For Former FSU Student Thrown From Wheelchair And Killed In South Florida Car Accident

A mass tonight will be dedicated to a Tallahassee woman thrown from her wheelchair and killed last month.

30 year old Jill Caputo - a state employee and FSU graduate - was struck by a car and killed August 10th as she tried to cross at the corner of Woodward and Jefferson Street.

A Tallahassee Police Spokesman says traffic homicide investigators are still working on the case and it could take another 60 to 90 days before they make a decision about whether charges will be filed against the driver of the SUV who hit her.

A special mass is being held for Caputo tonight at the Co-Cathedral of St. Thomas More (900 West Tennessee Street, Tallahassee). It begins at 5:15 and friends and colleagues will be invited to share memories of her immediately afterward.

Father Michael Tugwell says Caputo was a faithful parishioner at St. Thomas More since starting her studies at FSU. He says one of the first people on the accident scene had seen Caputo at church just days earlier and whispered a prayer in her ear as she lay dying.

South Florida Car Accident As Car Drives Into Deli

As two-dozen diners were getting lunch at Nosher's Deli Wednesday, an elderly woman drove a silver Toyota Camry through the restaurant's glass façade.

"You hear a tornado, a hurricane and an earthquake all at the same time," said Nosher's Deli co-owner Steve Galin. "You turn around and see this car driving at you. And she kept coming."

The Broward Sheriff's Office identified the driver as Rhoda Samuels, 79, who told a deputy that she was "pulling into a parking space at the Deli when she stepped on the gas instead of the brake pedal and accelerated into the business," according to an email provided by the agency.

Samuels was cited for careless driving.

Tamarac Fire Rescue Battalion Chief Patrick Kendrick said the driver and her female passenger were not injured when the vehicle entered the dining room at 7134 N. Nob Hill Road in Point Plaza, north of West McNab Road.

A Nosher's busboy and seven patrons were taken to area hospitals, according to the Broward Sheriff's Office and the restaurant owners.

The sheriff's office said the people injured in the noon crash were: Lourdes Maharaj, 43 of Margate; Leonore Danz, 89 of Tamarac; Marilyn Grossman, 74, of Tamarac; Rita Garfinkel, 82, of Tamarac; Shirley DiPietro, 78, of Tamarac; Ronald Etienne, 26, of Fort Lauderdale and Sharon Genyon, 71, of Philadelphia.

"It could have been a lot worse," Kendrick said. "There was no permanent structural damage and the business will be able to remain open."

After responders left the scene, Galin and co-owner Charlie Adelson were cleaning up broken glass, upended furniture and other damage to the 72-seat, New York-style delicatessen that observed its one-year anniversary Tuesday.

"I did not know the lady," he said of Samuels, the driver. "Fortunately, we're still in the off-season, so it wasn't a packed restaurant."

Galin said he did not expect to reopen until the weekend at the earliest. He still seemed shaken from the incident.

"We were able to free a lady customer who was halfway trapped under the car," Galin said. "The business can be rebuilt. Thank God no one was killed."

Officials Ready For Mercury Spill Cleanup In South Florida

Officials on Wednesday afternoon plan to start cleaning up mercury that a Margate man spilled on his driveway over the weekend and that neighborhood kids played with, police said.

Margate police and firefighters, as well as the state Department of Environmental Protection, have been warding off people from the spill site, in the 7800 block of Northwest Third Place, since a neighbor reported the hazardous area Monday afternoon.

Officials have spent the past two days scouring the neighborhood for additional mercury and planning the cleanup. Margate Police Detective Efrain Suarez said "all the people coordinating the cleanup" again met Wednesday morning, reviewing a plan to remove contamination.

The Margate resident who police said spilled the mercury, Hubert Jean, said he didn't know the silvery liquid was a toxin that can cause central nervous system problems.

"I didn't know what it was," he told the Sun Sentinel on Tuesday afternoon.

He said he and his girlfriend were cleaning out his garage on Saturday, getting ready to move, when he came across a silvery liquid he'd never seen before. Apparently the previous owner had left the mercury in the garage.

Jean said he gave a small canister of the liquid to one teen and several of the teen's friends soon visited him, asking for more mercury. Police on Monday came to Jean with complaints that kids were playing with the mercury.

On Tuesday, a group of five neighborhood kids, ages 11 to 15, said they had played with the liquid, which they found fascinating to look at and hold.

"We were just looking at it. We were touching it," said Daniel Aiello, 15. "It was just like a ball of silver."

Michael Jacinthe, 11, said he didn't think Jean, a friendly guy, intended to harm anyone.

"I feel bad for him," he said. "He just found it and said, 'Do you want to see it?' And me and my brother said, 'Yeah.' "

Suarez said all the teens appeared to be "doing fine." Jean said he and his girlfriend also touched the mercury but were OK.

It will be up to state or federal environmental officials to decide if Jean is cited or fined, Suarez said.

Family Involved In Fatal SUV Car Accident Gets $15.3 Million Jury Verdict

On May 24, 2006, plaintiff Ramon Moreno Jr., 30, a wrought iron laborer, was driving a 1994 Ford Explorer on California Highway 15 in Riverside County. His father, plaintiff Ramon Moreno Sr., 55, a carpenter; his cousin, plaintiff Adriana Sanchez Moreno, 32; and his brother, plaintiffs' decedent, William Moreno, 11, were passengers. The treads on the sport utility vehicle's left rear tired separated, causing Ramon Moreno Jr. to lose control of the vehicle. The car rolled down a seven-foot embankment. William's head was partially ejected from the vehicle and he suffered fatal head injuries.

The Moreno family had purchased the Ford Explorer in the spring of 2005 from a neighbor. At that time, unknown to the family, the car came with a recalled 12-year-old Radial ATX in the spare tire position. In January 2006, Ramon Moreno Sr. brought the car to an American Tire Depot in Monrovia to have the two rear tires replaced. American Tire, which is a Firestone dealer, suggested that the spare tire be rotated onto the vehicle because it appeared to be in a new, unused condition. Ramon Moreno Sr. agreed to this.

Ramon Moreno Jr., Ramon Moreno Sr., Adriana Sanchez Moreno and Maria Elena Moreno sued ATV Inc., which was doing business as American Tire Depot Inc., Bridgestone Americas Holding Inc., Bridgestone Americas Tire Operations LLC, Bridgestone Corporation, Bridgestone/Firestone Americas Holding, Bridgestone/Firestone North America Tire LLC and Ford Motor Co.

Ford Motor and the Bridgestone/Firestone companies settled prior to trial for confidential amounts.

At trial, the plaintiffs alleged that American Tire Depot was negligent for recommending the use of and installing a 12-year-old recalled spare tire.

Plaintiffs' counsel argued that American Tire Depot was licensed to sell Bridgestone/Firestone tires and should have known about the recall on the Radial ATX tires. In October 2005, Bridgestone/Firestone issued a technical bulletin to its dealers recommending careful inspection of and removal of all tires that were 10 years old or older, including spare tires, plaintiffs' counsel contended.

Defense counsel for American Tire Depot argued that Ramon Moreno Sr.'s receipt from the tire replacement did not show that the spare tire was rotated into service.

Plaintiffs' counsel countered that a work order that Ramon Moreno Sr. initialed would have shown the actual sequence of work, substantiating the plaintiffs' claims, but American Tire Depot claimed that the work order could not be found, counsel stated.

Defense counsel also contended that if the company had rotated the spare tire into use, old tires are not necessarily dangerous and that there is no fixed expiration date for tires. Counsel argued that the recall on the Radial ATX was in 2001 and had since ended. American Tire Depot had no responsibility to pull old or recalled spare tires out of service.

Defense counsel claimed that the Ford Explorer was defective and contributed to the accident due to its lack of rollover stability and faulty seat belt. Counsel argued that Ramon Moreno Jr. should have controlled the vehicle and that the tire de-treading did not adversely affect the vehicle's handling.

William's head was partially ejected from the vehicle and he sustained fatal head injuries. He died at the scene of the accident from massive head trauma. His parents, Ramon Moreno Sr. and Maria Elena Moreno, claimed wrongful death damages for loss of companionship and society.

The occupants of the vehicle sought damages for medical expenses, pain and suffering and emotional distress, which included bystander mental anguish for witnessing William's death.

Ramon Moreno Sr. suffered a broken wrist, lacerations, contusions and had severely elevated blood sugar levels after the accident. He was a diabetic. He was admitted to the hospital and was treated with blood pressure and blood sugar medications, a cast and sling and short term use of a cervical collar.

Ramon Moreno Jr. suffered lacerations on his scalp and some bruising and was evaluated and released from the emergency room a few hours after the accident.

Adriana Sanchez Moreno suffered a sprained neck, contusions and other sub-clinical soft-tissue injuries and soreness. She was treated and released from the emergency room with a cervical collar.

The jury found that American Tire Depot was 85 percent responsible, that Firestone was 15 percent responsible for the accident and that Ford was not liable. The jury awarded Ramon Moreno Sr. $5,026,591.68, Ramon Moreno Jr. $3,505,379.08, Adriana Sanchez Moreno $516,045 and Maria Moreno and Ramon Moreno Sr. $9 million. The award total was $18,048,015.80.

American Tire Depot is responsible for 85 percent of the non-economic damages and for the majority of the economic damages, for a total of $15,343,093.04.

Driver Falls From Car On I-95

Connecticut State Police say a man fell out of his car onto Interstate 95 and watched his vehicle drive on for about two-tenths of a mile before it crashed into a pole.

Troopers say they're not sure why 51-year-old Robert Craig of Killingworth fell out of his 2006 Dodge Charger late Tuesday morning in Darien near Exit 10. Police say Craig was treated for minor injuries at Stamford Hospital.

State police say Craig fell onto the highway but wasn't struck by any vehicles. They say other motorists stopped to help him and get him to safety.

Troopers say the car continued down the highway before striking a light pole and metal guardrail on the right shoulder.

The accident remains under investigation.
